Obama administration's anti-Paxton pile on collapses....

This case was always a legal fiction that was only intended to run up Ken and Angela's legal bills, but FANTASTIC news nevertheless:

In the Court’s order, the Judge Amos L. Mazzant, III (an Obama appointee) wrote, “This case is not about whether Paxton had a moral obligation to disclose his financial arrangement with Servergy to potential investors. This case is also not about whether Paxton had some general obligation to disclose his financial arrangement to his investor group. The only issue before the Court is to determine whether the facts as pleaded give rise to a plausible claim under federal securities laws. With that limitation in mind, the Court has determined that under the facts pleaded by the Commission, Paxton did not have a legal obligation to disclose his financial arrangement.”

The Court concluded “that the Complaint has not alleged facts sufficient to support a plausible claim under Sections 17(a) and 17(b) of the Securities Act or Sections 10(b) and 15(a) of the Exchange Act.”

The SEC asked the Court to give it an opportunity to amend its Complaint and the federal judge responded saying that “While this request does not satisfy the requirements of Federal Rule of Civil Procedure 15, the Court is inclined to allow the Commission to plead additional facts, if any, before it grants the motion and dismisses the Commission’s claims against Paxton.”

The Court ordered that Paxton’s Motion to Dismiss was conditionally granted “pending the Court’s review of the Commission’s submission of additional facts.” He granted the Commission “leave to amend its allegations against Paxton to the extent that it has additional facts that might support a claim under the statutes alleged in the Complaint.”

“This is a victory for Ken Paxton. Obviously, we are pleased with the Court’s ruling today,” said Matthew Martens.

Bill Mateja, a lawyer on both Paxton’s SEC and criminal defense teams added “now we turn our attention to Ken’s exoneration in the state matter where the prosecutor’s burden is even higher. The fraud allegations in the SEC case mirror those in the state case.”

Any amendment to the Complaint by the Commission was ordered to be filed within 14 days of the October 7th order.

Under the leadership of Texas Attorney General Greg Abbott, the office’s Child Support Division received an Exemplary Performance Award from the Western Interstate Child Support Enforcement Council (WICSEC). The award recognizes a state, regional, county or tribal program that consistently and comprehensively exemplifies excellence in child support enforcement. The award was accepted for Attorney General Abbott by Charles Smith, Deputy Attorney General at the WICSEC 2014 Annual Training Conference in San Diego, California.

The Texas program ranks first in the nation for collecting more than $3.6 billion in child support for the federal fiscal year that ended Sept. 30, 2013 according to the statement from the Attorney General’s Office. According to the Fiscal Year 2013 Preliminary Data Report released by the federal Office of Child Support Enforcement, Texas is first among 54 states, territories and districts for the amount of child support collected, the amount of child support collected per employee, and cost effectiveness.

Based on 2013 performance data, Texas leads the country in collections per child support employee. Texas’s collections per employee averaged $1.35 million, compared to the national average of $560,000 per employee. In addition, by collecting $11.61 for every dollar spent, the Texas program ranks first in cost effectiveness, and surpasses the national average of $5.47 by 212 percent.

Movie Review: Atlas Shrugged, Part 3; "Who is John Galt?!?"

Dallas, TX -- Earlier tonight, we were blessed to attend an advance screening of Atlas Shrugged, Part 3: Who is John Galt?!?  The film followed the arc of creeping, incremental statism to its logical conclusion.  Blackouts, deprivation, and tyranny was the result.

The movie won't please hardcore Randian purists.  Rand's book is 1000 pages long and editorial decisions had to be made.  For everyone else, the film is a worthy tribute to the power of freedom to promote human flourishing.

The film begins with the revelation of John Galt's origins in the takeover of the factory where he worked by new Marxist management.  Moving on, we see Dagny Taggart's time in the Colorado  valley where Galt and the leading entrepreneurs of his day have gone on 'strike' to the outside while creating a prosperous small community.  While she sympathizes with Galt's objectives, she eventually leaves to rescue her family's railroad, which is suffering from mismanagement under her brother Joe Straus James.

James is more interested in cronyism than productive economic activity.  During Dagny's absence, he supported a railroad centralization law.  While the law made him short term blood money, it proved disastrous for the railroad.  Dagny again fixes a problem created by James.  Eventually, James cannot handle the contrast between his crony failures and the successes of his counterparts who believe in freedom.

The climax of the film is John Galt's speech.  The first two-thirds of the film tease a speech by 'head of state' Harrison, where he's supposed to explain to the nation his 'solution' to the economic crisis: MORE STATISM!!!  In a manner reminiscent of Andrew Breitbart with Anthony Weiner, John Galt hacks into the broadcast feed of Harrison's speech and explains the ongoing producer strike.  To the horror of the crony government, Galt's speech becomes a rallying cry to the multitudes who don't support government policies.  Naturally, the government cracks down.

One MAJOR warning: the film contains an unnecessarily graphic sex scene between John Galt and Dagny Taggert.  While no body parts are exposed, they don't have to be.  This website STRONGLY encourages the produces to curtail this scene dramatically before the final cut of the film is released in two weeks.

Statism is a destructive, satanic philosophy that begets death and poverty.  Unfortunately, it also enriches a small crony elite, who go to extreme lengths to protect their blood money (hello Texas House).  Atlas Shrugged Part 3 follows this dangerous philosophy to its natural conclusion.  Blackouts, deprivation, and tyranny is the inevitable result.  Atlas Shrugged, Part 3 hits theaters September 12th.

Rick Perry, Marijuana, and our first conversation

Last week, in Davos, Rick Perry made a comment about marijuana that ignited a media firestorm:

“As governor, I have begun to implement policies that start us toward a decriminalization” by introducing alternative “drug courts” that provide treatment and softer penalties for minor offenses"

The only noteworthy aspect of that statement is the reaction.  Perry was discussing criminal justice reforms Texas has put into place over the past decade.  Perry said nothing new.

In January 2010, during his last campaign for governor, Perry held an event with Andrew Breitbart.  This event was the first time we met the Governor.  In a private conversation on the side of that event, Perry described his administration's policy towards low level drug offenses using language that was nearly identical to what he said in Davos four years later.

At the time, Perry was fending off a primary challenge from Debra Medina (who, in 2014, is running for comptroller).  A long time Ron Paul acolyte, Medina is a well known critic of the war on drugs.  While Perry differentiated himself from Medina's position on drug legalization, he also made clear his belief that incarcerating people over low-level drug offenses is a counterproductive strategy that wastes a lot of money.

On a similar note, in his 2010 book Fed Up Perry wrote:

But perhaps most interesting is a movement I disagree, while appreciating the desire of Californians to decide for themselves -- and this is the issue of marijuana consumption.  A few years ago, Californians legalized the limited medicinal use of marijuana, but the Supreme Court struck this law down in Gonzales v. Raich, claiming that the federal government has the power to regulate activity that would have a substantial effect on interstate commerce.  Now, I am not sure the people of Texas would want to go down this road, but it sure seems to me that Justice Thomas got this one right when he said in dissent:..."Our federalist system, properly understood, allows California and a growing number of other States to decide for themselves how to safeguard the health and welfare of their citizens.  (164/5)

 Rick Perry's policy towards low-level drug offences has always reflected his commitment to the Tenth Amendment and the fiscal lunacy of mass incarceration.  Rick Perry said nothing in Davos that he didn't say to us in 2010.  The real story is that the media belatedly chose to cover a Perry administration policy that has been in place for at least half-a-decade.

Linda Lovelace is one of the more interesting figures of the Sexual Revolution.  The star of the breakthrough pornographic film Deep Throat (not gonna provide a link), she later told the truth about the gross exploitation in the pornography industry.  According to Brietbart.com, however, Hollywood is only interested in glamorizing the pornographic career Linda Lovelace was coerced into having; money quote:

Linda Lovelace, who rose to infamy thanks to her starring roles in several '70s adult films, became a vocal anti-porn crusader in her later years. 

You won't see that side of her story in the upcoming biopic based on her tragic life.

Welcoming Brietbart Sports

This morning, Breitbart.com announced the addition of Breitbart Sports to the Breitbart family; this is a welcome development in the culture war.

Sports media is a primary transmission mechanism for what Andrew called 'liberalism by osmosis,' where a generally apolitical population receives Marxism in small, subtle, doses that shifts public opinion over time.

The best way to illustrate this phenomenon is with an example from my personal life.  Back in 2008, I was looking at polling data from that election with ESPN playing in the background.  I was trying to understand why public opinion had shifted so dramatically against Sarah Palin when, on cue, the ESPN anchors chimed in with back-to-back-to-back 'Sarah Palin is stupid' jokes.  People who didn't follow the news got their view of Sarah Palin shaped by ESPN.  That moment was my personal epiphany, but the insidious role of sports media is obvious to anyone paying attention.

Since 2008, it's gotten worse.  From denigrating Tim Tebow's faith, to Bob Costas' recent endorsement of gun-grabbing, sports media's influence on our culture is undeniable.  It's long past time to hold sports media accountable.

In the short term, this means getting in front of this phony NFL-concussion 'issue.'  Lawsuits are here, and the sports media will help turn this into a boondoggle for trial lawyers.  Bullcrap.  Most NFL players who go broke do so through their own stupidity.  The coming cultural kerfuffle over NFL concussions is a fight we can win.

Culture is upstream of politics, and sports is often at the front line of culture; this is a shrewd move by the Brietbart crew.

Family Friendly Television Alert: The Original Transformers

Here at Cahnman's Musings, we echo the late Andrew Breitbart's belief that 'culture is upstream of politics.'  We concur that if we change the culture, politics will take care of itself.  In that spirit, Cahnman's Musings is pleased to report that we've recently rediscovered a 1980's television show that deserves commendation and support for it's dedication to a traditional moral foundation.

The original Transformers was a Saturday morning cartoon in the mid-1980's.  Unlike the rotgut you see today, it sought to build upon the foundation of America's founding culture.  The worldview of the show is surprisingly biblical.

Optimus Prime, at least as he's portrayed in the original cartoon, is a Christ-like figure.  He unquestioningly does the right thing because it's his duty, and he's always humble instead of braggadocios in victory.  Oh yeah, he also wins every time.

Where this show really gets fun, however, is the Decepticons.  Just the fact that the bad guys in the show base their name around deception tells you everything you need to know about them.  The Decepticons hide from the truth and distract, because that's the only way they can 'win.'  But they never do win, because their greedy, selfish, wickedness is no match for the righteousness of the Autobots led by Optimus Prime.  The Decepticons are also miserable.

In 2012, it's more important than ever to support entertainment that emerges from a Judeo-Christian worldview.  There's precious little out there and what there is deserves commercial success.  The original Transformers cartoon series from the mid-1980's does just that.  Evil always loses, the Good Guys always win, and the good are humble in victory.  This Christmas season, Cahnman's Musings wholeheartedly recommends the original Transformers.

MOVIE REVIEW: "The Project" on TheBlazeTV

Since the 2010 controversy over the Terrorist Victory Monument Ground Zero Mosque, Islamic cultural subversion in the United States has come under scrutiny.  "The Project" on theBlazeTV examines the state of play surrounding Islamic cultural subversion and is required viewing for anyone who wants to understand current controversies.  "The Project" should also be viewed by anyone who believes Islamic cultural subversion is not a big deal.

Contemporary Islamic cultural subversion is very similar its Communist equivalent from the 1930's to the 1950's.  The project, written in 1982, is a document discovered by Swiss Law enforcement two months after 9/11.  Similar to the 1963 goals of the Communist Party USA, the project outlines the Muslim Brotherhood's "Grand Jihad" to "eliminate and destroy Western Civilization from within."  The project advocates taking over Western Civilization by deception and evolutionary sabotage, rather than revolution.  The endgame, however, is exactly the same as Usama bin Laden's

Islamic 'scripture' commands all Muslims to conquer the Globe in the name of Allah.  While they agree on the goal, Muslims disagree on timing and tactics.  Moderate Muslims believe the time of Global Dominance is so far in the future that they have no special obligation to bring it about.  Radical Jihadists, however, believe they are obligated to bring Islamic dominance into being.  There are two types of radical Jihadists: violent and stealth.  Violent Jihadists, like Usama bin Laden, believe in direct confrontation.  Stealth Jihadists, by contrast, seek to weaken us from within first and kill us later; the Project details the plan for stealth cultural subversion.

"The project" chronicles Islamic cultural subversion in the United States over the past decade.  Just like the minions of Saul Alinsky, the primary strategy of civilizational Jihadists is to entrench themselves and corrupt influential institutions from within.  That starts with culture, education, and media then moves quickly to finance and government.  For Islamic cultural subversives, the current operational objective is to silence honest discussion of Islamic 'scripture;' their primary tactic is political correctness and the word 'Islamophobia.'  Islamophobia, a term deliberately modeled after similar homosexual efforts, is designed to slander anyone who honestly discusses Islamic 'scripture' as a bigot.  Of the many examples cataloged, I find the purge of FBI training materials most disturbing.

This is not a Democrat/Republican issue.  Both parties are guilty.  Infiltration by Islamic cultural subversives began under George W. Bush, it's gotten infinitely worse under Barack Obama.  This past summer, when five members of Congress sent letters requesting more information to the Inspectors General of five federal departments, they were first attacked by Republicans.  The only difference is that where establishment Republicans are either willfully blind or ignorantly profiteering, the Barack Obama Democrats are deliberately treasonous.

Moving forward, making public the documents already possessed by the executive branch is the top priority.  In the 2008 Holy Land Foundation trial, the Bush Justice Department provided 80 boxes of discovery material to the defense.  After the Obama administration came into office, those boxes were sealed away in a federal warehouse.  While the public cannot access those documents, an even bigger outrage is that Congressional Intelligence Committees cannot access them either.  The United States cannot solve this problem until the public (or at least Congress) grasps its magnitude.

For those of us who believe in the Judeo-Christian foundation of Western Civilization, a dirty little secret exists.  The struggle against Islamic cultural subversion is almost identical to the struggle against Communist cultural subversion.  With courage and truth, we can defeat both; hopefully without firing a shot.  Andrew Breitbart famously observed that culture, education, and media lie upstream of policy; that's just as true for cultural Jihad as cultural Marxism.  Step 1 is to honestly, if belatedly, define our enemy and their objective.  "The project" on theBlazeTV does exactly that, using that enemy's own words.  Do you want to face the ugly truth, or are you afraid?!?

MOVIE REVIEW: "The Hope and the Change" by Citizen United Productions

This review is proof of God's all powerful sense of humor.  I've been in touch with the P.R. department at Citizens United for the past week to get my copy of "Occupy Unmasked."  For all that effort, last night I saw Citizens United's other new release, "the Hope and the Change."

This documentary is devastating to Barack Obama.  It chronicles the disillusionment and travails of a dozen or so 2008 Obama voters who will not vote for him a second time.  These are the voters who, in 2008, pulled Barack Obama across the finish line.

My biggest takeaway from the movie is the day-to-day struggle that life under Barack Obama has been for a substantial chunk of Obama's own voters.  While life has been (very) challenging for us all, for these 2008 Obama voters Obama's economic devastation is acute and unrelenting.  Comments like "I have never been more broke in my life," "I'm sick of only having ten dollars in my bank account," and "I am not seeing one ounce of benefit for all this debt" illustrate the economic calamity these 2008 Obama voters face.

For these 2008 Obama voters, Barack Obama's policies have been inexplicable and infuriating.  It started with the bailouts.  For these 2008 Obama voters, "bailing out car companies and banks surprised a lot of people."  Alongside the bailouts, "the stimulus was a shocker as well" because "I don't know where all this money is going," when, in reality, "we just printed more money."  Making matters worse, "I got really scared when I saw the Health Care package" since "the more I understood, the more I became concerned" when "there were better solutions" than this "tax on the middle class."  Obama's policies are divorced from these 2008 Obama voters' lives, but they understand they're getting stuck with the bill; "it's a complete hustle and we're the butt of the joke."  The anger is palpable.

For conservatives, it's important to understand that persuadable 2008 Obama voters aren't the morons or Jon Stewart's audience.  These are the folks Andrew Breitbart famously referred to as "Democrats by Osmosis."  Their family or social circle were Democrat, and they went along without thinking.  Most important, their underlying values are conservative.  Barack Obama has alienated the voters who pulled him across the finish line in 2008: "I work hard for what I have and I resent being told I have to give it to someone else."  In 2012, as Scott Rasmussen explained at RightOnline, we need to hammer results and record.  Over the longer term, however, we need to educate them to think ideologically.

On a personal note, I was struck by the section on National Security issues.  As regular readers know, I've been freaking out about National Security for the past couple months.  Persuadable 2008 Obama voters agree: "the United States is not respected the way it used to be" because Obama "has shown more weakness than strength."  For the record, all these interviews were conducted after the bin Laden raid but before our embassies were attacked.  For conservatives, this is a very encouraging sign.

For those of us who want to destroy the institutional left, "the Hope and the Change" is a priceless guide to the rest of this cycle and what comes next.  A substantial chunk of Barack Obama's 2008 voters do not share Obama's satanic values.  Persuadable Obama 2008 voters have conservative values, they just vote Democrat by default.  Between now and election day, hammer results; after election day, however, these folks need ideological education.  The good news is that these folks are very open to what we have to say, and "the Hope and the Change" is a fantastic guide for their concerns.

The Arab faux-spring was sold to all of us by the media, hawking the Kumbayah peace, love and democracy party line, and now they are reaping what they have sown. And to make matters worse, they are betraying the very first amendment upon which they are dependent in order to CONTINUE to support this President.

What Glenn Beck's Return to TV means for Fox

He's baaaaaack; today on his radio show, Glenn Beck announced:

“Today TheBlaze has announced and the New York Times front page of the business section has announced that TheBlaze TV is now officially a television network as well as an Internet television network. Today we are debuting on our first carrier, DISH. In fact, if you are at home in some parts of the country, it has started already,”

This is huge; along with Breitbart, it will change the media.

As great as this is for conservatism, it could be a mortal threat to Fox News.  Fox News has been able to prosper by being less bad than the other cable networks.  TheBlaze's emergence on television means that cannot continue.

Fox News, even before Roger Ailes' infamous "course correction," always shared the shortcomings of cable news with it's lower rated competitors.  Cable news, at least as it's currently understood, spends too much time reacting to the news of a day.  Cable news wastes time on brainless crap.  Cable news uses the ossified Democrat Strategist/Republican Strategist as a crutch.

There's a reason why, when he was at Fox, Glenn Beck had the most successful show on the network.  Glenn Beck went beyond the news of the day.  Glenn Beck explained the Progressives.  Glenn Beck explained Cloward and Piven.  Glenn Beck broke the Chicago Climate exchange.

I've always said that Fox News, while it doesn't (or didn't pre-course correction) share the political biases of the rest of the media, still shares the cultural biases of the NYC/DC/LA set.  Glenn Beck has never been part of that crowd, even when he lived in New York.  Glenn Beck is culturally Middle American and, as such, he lives in truth.

Fox News better step up it's game, otherwise Glenn Beck will leave them in the dust.

Why the RealClearPolitics Average Is Not Reliable

For those of you unaware, Real Clear Politics is a website that tracks polling data and aggregates news.  It's claim to fame is a feature, known as the RCP Average, that taken the mean of all public pollingf over the past 2-3 weeks.  Unfortunately, the RCP average is very easy for corrupt polling outlets to manipulate.

As Rush has pointed out for years, a lot of polling is designed to shape public opinion, not reflect it.  This longstanding problem has gotten much worse in the 2012 cycle.  As long as 1-2 crap polls come out per month, it throws the RCP average off.

For example, the current RCP average has Obama up by 2.7.  That average, however, includes this garbage poll from NBC News/Wall St. Journal and this craptacular specimen from Pew; Breitbart News demolishes the first poll here and the second one here.  Once those two polls are removed, Obama's lead plummets to 1.2%.

This means that, out of the past 9 public polls, 2 crap polls are responsible for 55% of Obama's lead in the RCP Average; this phenomenon has been going on for years.

So, what should you do?!?

Personally, I stick with Rasmussen.  They were the most accurate pollster in 2004, 2006, 2008, and (most importantly) 2010.  Scott Rasmussen was the first pollster to recognize how the Tea Party has altered the American Electorate for the foreseeable future.  Wisconsin is the first place we've seen these results.  As Scott Rasmussen explained at RightOnline, we should expect similar results as long as the interrelated issues of unemployment and debt drive the conversation.

This is not a personal attack on RCP.  RCP isn't corrupt.  RCP's methodology, however, leaves them vulnerable to the corruption of others.

RightOnline 2012: The Biggest Takeaway

I attended the RightOnline 2012 Conference this past weekend.  It was awesome.  We're winning and we just need to keep going.

I sat down to write a review of the conference, but there were 25 separate items I wanted to discuss.  A detailed review isn't feasible, especially with Biblical Prophecies coming true in today's headlines.  Instead, I wanted to share a strategic observation on the broad trends we're facing.

The big takeaway is that we're winning.  The most important action we can take is to continue doing exactly what we're doing.  This process is a long-haul, but as long as we maintain consistent, persistent, pressure, we'll win.

In terms of substance, Scott Rasmussen was the most important person I had a chance to speak with.  His point was simple: the public outrage is real, it began with TARP and was solidified by Obamacare, and it has transformed the electorate.  Even when they don't follow politics closely, the public instinctively understands the size of the problem, and they're open to big solutions.  The Wisconsin recall results confirmed something I've suspected for awhile.  Scott Rasmussen's analysis, in both public remarks and our personal conversations,  was further proof.  Update:  Rasmussen Speech Here

One modest caveat is that, in the realm of public opinion, results are more important than theory.  As Scott Rasmussen said "people don't care about limited government, they care about the type of society limited government will create."  Although the public in Wisconsin supported Scott Walker in the Abstract, it wasn't until their property taxes went down that Scott Walker won the election.

Finally, I want to close by mentioning Andrew Breitbart.  For obvious reasons, Andrew was a major topic of conversation this weekend.  Andrew's #1 objective in this world was to empower the rest of us to take on Hollywood and the corrupt media.  Just today, Chris Cilizza of Washington Post came up with this whiny crybaby piece, that Rush brilliantly destroyed.  That Cilizza piece proves how much trouble the left is in.  The best way to honor Andrew Breitbart is to continue doing exactly what we're doing.  We're winning, and as long as we stay in the fight, we're gonna kick their ass.

Ronald Reagan and the Power of Truth

Yesterday was the twenty-fifth anniversary of Ronald Reagan's Tear Down this Wall Speech:

I had the opportunity to hear Peter Robinson, the Reagan aide who drafted the speech, discuss its Genesis today in Austin.  I was struck, overwhelmingly, by the powerful simplicity of truth.

The Book of Ephesians calls God's word "the sword of the spirit" (6:17 KJV); Psalm 119 makes clear that His word is Truth.  Through God, truth frequently acts as a sword.  Ronald Reagan understood this reality.

The struggle between Freedom and Totalitarianism in Geopolitics is an extension of the struggle between Good and Evil that began in the Garden of Eden.  As our founders understood, man's freedom derives from the fact that God created us in His image.  Totalitarianism, like all Satanic Ideologies, can only exist on top of lies.  Truth slays lies, which is why totalitarians intimidate people against truth.  On a related note, this is why the American left is so desperate to put Rush Limbaugh out of business.

Robinson spoke today about the speech-writing trip he took to Berlin in advance of the President.  While in Berlin, the State Department bureaucracy, content to manage lies, told Robinson the residents of Berlin didn't really care about the Wall.  In contrast, an actual resident of Berlin, upon being asked about the Wall, indignantly asked Robinson: "My sister lives a few miles that way [pointing at the Wall] and I haven't seen her in 20 years; how do you think I feel about the Wall?!?"

When Andrew Breitbart died, I wrote:

Andrew Breitbart stood for Truth.  We have to restore that truth.  We have to restore the truth about God.  We have to restore the truth about History.  We have to restore the truth in our Culture.  We have to restore the truth about our Economy.  We have to restore the truth about our Government.  The truth can be terrifying, especially at first, but the lies will kill you.

Truth is simple, even though it's often not easy.  Totalitarians, like all minions of the Great Deceiver, disugise truth and intimidate those who seek and speak it.  Ronald Reagan's stunning political success resulted from his personal grounding in Truth.  Not surprisingly, Jesus Christ said it best: "And ye shall know the truth, and the truth shall make you free. (John 8:32 KJV)"
