#TXLEGE: No Good Options
"Little children, it is the last hour; and as you have heard that the Antichrist is coming, even now many antichrists have come, by which we know that it is the last hour."
1 John 2:18
Whole bunch of people filed for speaker in the past week. None of them good. You're welcome to read about the details here.
Keep your expectations low.
There's no reason to believe anything will change.
Regardless of the speaker's specific identity, ninety percent of the Texas house's legislative output will be crony capitalism and/or shady real estate deals.
Kudos to Kyle Biedermann and Bryan Slaton for trying to force a culture change. They're fighting the good fight. More power to 'em. But the OVERWHELMING majority of house members like things the way they are.
This is a contest between Giant Douche and Turd Sandwhich (where Giant Douche is passed out drunk in Charlie Geren's office).
Bottom Line: That light you see at the end of the tunnel...it's a train.

#TXLEGE: Latest Crisis Subsides, Toxic Culture Remains
"Whoever has no rule over his own spirit
Is like a city broken down, without walls."
Proverbs 25:28
Sigh:
State Rep. Rick Miller, R-Sugar Land, is no longer running for reelection after he sparked a firestorm for saying he was facing primary challengers because they are Asian.Obviously, this was the least bad solution. Had Miller not withdrawn from the race, this would have become a slow drip. So one cheer.
“During a recent interview with the Houston Chronicle I made some statements that were insensitive and inexcusable,” Miller said in a statement to The Texas Tribune. “In trying to make a point about the campaign I used a poor choice of words that are not indicative of my character or heart.
“I do not want to be a distraction for my party or my constituents, and therefore I have decided not to seek re-election,” he continued.
We guess.
But does anyone feel good about this?!?
After Bonnen left, we wrote:
[I]s anyone confident a new scandal won't soon emerge?!?Barely six weeks later...another frickin' scandal!!!
Cuz' we ain't.
We've seen this movie:
From October:
This specific scandal is the completely predictable result of the toxic culture in the Texas capitol that has prevailed for a long time.Yet, here we are. Again. Rick Miller, Dennis Bonnen, and Jim Pitts might be gone. But Charlie Geren and Jim Murphy are still there.
The GOP, meanwhile, has been running the place for a quarter century.
This is the same Republican majority that:
- Five years ago, was running college admissions scandals before it was cool.
- With all due respect to Aunt Becky, she ain't got nothin' on Jim Pitts.
- Two years ago, put a man who had been in a sexual relationship with a lobbyist for over a decade in charge of writing its sexual harassment policy.
- Just elected as vice chair a guy who was taking $56,000 a month from an entity under the jurisdiction of the committee he chaired.
The pattern is obvious...to anyone not under the influence of afore mentioned Egyptian rivers. It can't be defended, and it shouldn't.
Is anyone confident about that?!?
Cuz' we (still) ain't.
Bottom Line: Over/under six weeks before the next self-inflicted scandal?!?

#TXLEGE: Acute crisis subsides, Toxic Culture Remains
"For godly sorrow produces repentance leading to salvation, not to be regretted; but the sorrow of the world produces death."
2 Corinthians 7:10
This was always inevitable:
Texas House Speaker Dennis Bonnen (R-Angleton) announced this morning he would not seek reelection to the Texas House. Two and a half cheers.
“Since Friday, I have had numerous conversations with Members who care deeply about the Texas House, and I respect the manner in which they have handled the entire situation. After much prayer, consultation, and thoughtful consideration with my family, it is clear that I can no longer seek re-election as State Representative of District 25, and subsequently, as Speaker of the House,” said Bonnen in a statement.
“I care deeply about this body and the work we have accomplished over the years, namely, the outstanding success we achieved in the 86th Legislature,” he continued.
This announcement comes after Michael Quinn Sullivan, of the conservative grassroots group Empower Texans, released a recording of a closed-door meeting he had with Bonnen, in which Bonnen offered a clear quid pro quo — Texas House media credentials in exchange for Sullivan monetarily targeting 10 select “moderate” Republican House members.
It's certainly good that Bonnen is gone. It always serves the public's interest to remove corrupt officials. Furthermore, Bonnen's departure reduces the odds of a GOP electoral wipeout.
Still, it's hard to get too excited. It took them three months to make a completely obvious decision. It should have taken about three days.
Last Saturday we wrote that, given their inability to do that which is completely obvious re: Bonnen, the GOP deserved to lose the Texas house. Obviously, this morning's announcement renders most of the specifics of that blog post moot. Still...is anyone confident a new scandal won't soon emerge?!?
Cuz' we ain't.
As we wrote:
It's no longer just about Dennis Bonnen. Or one act of political funny business. This specific scandal is the completely predictable result of the toxic culture in the Texas capitol that has prevailed for a long time.Dennis Bonnen (and Joe Straus and Jim Pitts) might be gone, but Charlie Geren and Jim Murphy remain.
The GOP, meanwhile, has been running the place for a quarter century.

The pattern is obvious...to anyone not under the influence of afore mentioned Egyptian rivers.
It's hard to feel confident in a culture that continues to tolerate the likes of Charlie Geren and elevates the likes of Jim Murphy.
Even if they did (very, very, belatedly) throw Dennis Bonnen overboard.
Bottom Line: We're certainly in a better place now than we were twelve hours ago...but that's not saying much.

#TXLEGE: At this point, the GOP deserves to Lose the Texas house
"When the righteous are in authority, the people rejoice;
But when a wicked man rules, the people groan."
Proverbs 29:2
Never, ever, ever underestimate the cowardice, or the stupidity, of the Republican caucus in the Texas house:
Just in — Statement from House Republican Caucus on Bonnen-Burrows-MQS: pic.twitter.com/ifxTJqxNhD— Patrick Svitek (@PatrickSvitek) October 18, 2019
That one has to go to the Twitter feed of a Texas Tribune reporter to find that statement, while the GOP caucus hasn't posted it to their own, tells you everything you need to know.
We'd call it denial, but we don't want to insult Egyptian rivers.
In other words:
Yet here we are.
It's 2006 on steroids.
We don't have anything new to say about this specific scandal. There's nothing we can say that we didn't say three months ago. And two months ago. And ten days ago.
Yet here we are.
It's no longer just about Dennis Bonnen. Or one act of political funny business. This specific scandal is the completely predictable result of the toxic culture in the Texas capitol that has prevailed for a long time.
The New York Times, meanwhile, gets in on the act:
AUSTIN, Texas — With President Trump arriving in red-state Texas for a campaign rally in Dallas on Thursday, the Republican Party in the state faces a host of troubles.Obviously, a certain type of moron will reply "HashtagFAKENEWS" to the New York Times. That's fine. They'll get what they deserve.
The Republican-controlled Texas House of Representatives is engulfed in scandal. Six of the state’s 23 Republican members of the United States House of Representatives say they will not run for re-election, opening new opportunities for Democrats. And one of the state’s three top Republican leaders believes that the president has become a political liability among a crucial bloc of voters.
“With all due respect to Trump — who I love, by the way — he’s killing us in urban-suburban districts,” Dennis Bonnen, the speaker of the state House and the central figure in the legislative scandal, said in a 64-minute tape recording released on Tuesday.
The recording of a sometimes salty conversation Mr. Bonnen had with a conservative activist at the State Capitol in June includes a description of what critics have called a quid-pro-quo offer that is now under investigation by the Texas Rangers.
Mr. Bonnen says the tape, which was recorded without his knowledge, proves that nothing he said in the conversation broke any laws.
Even so, the political landscape in Texas will now feature both an embattled state leader struggling to hold on to the speakership and an embattled president confronting an impeachment inquiry — a prospect that unquestionably raises the stakes for Republicans in a state their party has dominated for more than two decades.
Consequently, “corruption and abuse of power become not just a national issue but potentially a state-level issue for Republicans as well,” said Jim Henson, a pollster and political analyst based in Austin.
To the reality based community, however, its' a warning.
You don't have to agree with every statement in that Times article to understand they've got the basic dynamic right.
The frickin' New York Times understands reality better than the majority party in the Texas legislature.
Think about that.
Yet here we are.
Bottom Line: The Democrats might not deserve to win. It might remain the case that they suck even more. It probably does. But it shouldn't surprise anyone if "might" fails to defeat currently observable reality.

#TXLEGE: Bonnen's "Select Committee on Mass Violence prevention" is a Rogue's Gallery
"Every one of the builders had his sword girded at his side as he built. And the one who sounded the trumpet was beside me."
Nehemiah 4:18
YIKES:
That list...pretty much speaks for itself.New: @RepDennisBonnen appoints 13 members to new House Select Committee on Mass Violence Prevention and Community Safety. Notably, @drewdarby4Tx is chair. #txlege pic.twitter.com/qHdc3QIEGL— Patrick Svitek (@PatrickSvitek) September 4, 2019
A couple of these can be justified due to geography. Specifically, Joe Moody and Cesar Blanco are from El Paso. So those are understandable. Likewise, Brooks Landgraf from Odessa.
Still...Poncho?!? Julie Johnson?!? Disproportionate Democrat representation?!?
[sarc]We're sure Chairman Drew Darby, Charlie Geren, and Giovanni Capriglione won't sell out our rights. [/sarc]
Bottom Line: That this committee has an equal number of D's and R's despite a solid R majority tells you everything you need to know.

#TXLEGE: Did Geren just BLUNDER us into ANOTHER Redistricting Lawsuit?!?
"Wine is a mocker,
Strong drink is a brawler,
And whoever is led astray by it is not wise."
Proverbs 20:1
H.B. 4181 was an anti-open government bill that passed this session. It carves the legislature out of the Texas Public Information Act. Sounds bad enough on its own...right?!?
But wait, there's more!!!
From Lauren McGaughy:
AUSTIN — Texas has passed a new law that lets lawmakers conceal their emails and other communications from public scrutiny, as they prepare to redraw the state’s voting maps.Wow.
....
In a statement to The News, [Bill Author Charlie] Geren said the new law codifies existing practice and protects lawmakers from overreach and outside pressure.
“Legislative privilege ‘serves important public purposes’ and ensures that members and their staffs are protected from substantial intrusions by the executive and judicial branch seeking to second guess the Legislature’s motives,” Geren said, citing a recent Texas Supreme Court case.
He then specifically mentioned the last round of redistricting in 2011. After a legal challenge, state lawmakers and legislative employees were ordered to release damning emails that helped advocates prove the state’s voting maps were racially gerrymandered.
Geren’s Fort Worth district was adjacent to one that the courts eventually ordered to be redrawn.
“They reached this conclusion in part because they said the privileges were not explicitly and completely spelled out in the Legislative Council statute,” Geren said, referring to the Legislature’s nonpartisan research agency. “House Bill 4181 codifies the common law of legislative privilege, developed from the Speech and Debate Clause of the Texas Constitution, as traditionally understood by the Legislature and the Texas courts.”
We're not sure what's worse: That Geren perceives the issue this way...or that he said so out loud to the Dallas Morning News.
Rather than addressing the incompetence that produced the last round of lawsuits, Charlie Geren's genius idea is to deny citizens access to information.
Speaking of geniuses, it doesn't take one to see how this plays out: Having been given another chance to sue their way into a favorable redistricting map...that's exactly what the Democrats will do.
If the file that lawsuit in front of the wrong judge...who knows?!?
Bottom Line: Texas is going to rue this bill for the next decade.

#TXLEGE: Guy who got rich via sexual relationship with lobbyist attacks honest man's business
"Wealth gained by dishonesty will be diminished,
But he who gathers by labor will increase."
Proverbs 13:11
In our piece yesterday about the house's actions on SB 2, we made the following point:
Just for good measure:We made the point yesterday, but it's worth considering on its own: The Senator who single-handedly made the property tax issue too hot for the legislature is having his personal business attacked by a committee chairman in the other chamber.
One amendment, from state Rep. Charlie Geren, R-Fort Worth, seems to bar anyone but licensed attorneys from representing taxpayers in the property tax appeal process on a contingency fee basis. The change would likely affect the author of SB 2, state Sen. Paul Bettencourt, a Houston Republican and a property tax consultant. In other words, Charlie Geren is literally attacking Paul Bettencourt's business...and the house members are fine with it.
“It affects a lot of people. We'll talk about it in conference,” Geren said. He added, “I don't believe in contingency fees, but if we have to have contingency fees to do this, then I want the lawyers to do that."
Having. His. Personal. Business. Attacked.
But, coming from Geren, it's even worse.
In case you forgot:
AUSTIN (KXAN) -- On Jan. 10, 2017, lobbyist Mindy Ellmer tweeted a picture of her with long-time boyfriend Rep. Charlie Geren, R-Fort Worth, standing next to the Mayor of Fort Worth, Betsy Price. The caption read, "Happy to kick off the 85th with two of my favorite peeps."We've said our piece about the sordid relationship between Charlie Geren and Mindy Elmer, during a previous act of chutzpah from Charlie, here and here and here.
More than four months later, Rep. Geren is a driving force for a bill critics say will save the telecommunication giant AT&T hundreds of millions of dollars while taking needed revenue from city coffers in Austin and beyond.
Ellmer has an interest in the company's success in Geren's Texas House of Representatives. She holds a contract from AT&T worth up to $99,999 to try and influence lawmakers to vote on issues favorable to AT&T.
"I don't have any comment at this point in time, thank you," Rep. Geren told KXAN in a brief phone call after repeated requests for his thoughts on if the relationship was a conflict of interest.
And now Geren's hijacking Paul Bettencourt's property tax bill to attack Bettencourt's personal business.
For no other reason than that Paul Bettencourt made property taxes too hot of an issue for the legislature to ignore.
Bottom Line: The Texas Legislature...it really is THAT sleazy.

#TXLEGE: The most toxic house in Texas
"That which has been is what will be,
That which is done is what will be done,
And there is nothing new under the sun."
Ecclesiastes 1:9
Well, property tax "reform" is out of the house...but this is quite the poison pill:
Stickland fueled the boiling over of the evening, though, bringing forward the final amendment for consideration. The contentious measure he offered would strike the newly added contingency clause in the bill. Amendment 48 would essentially decouple SB 2 from House Bill 3, which is currently in the Texas Senate committee process. In other words, they've made even the tiniest, most incremental, improvement in the property tax system contingent upon their orgy of spending masquerading as "school finance reform."
The clause Stickland was after is the language added by Burrows into the property tax reform legislation last week that will only afford taxpayers reform and relief if lawmakers pass the school spending spree contained in HB 3. As substituted by Senate Education Chairman State Sen. Larry Taylor (R–Friendswood), that legislation added a contingency clause of its own that makes half of the appropriated monies for property tax relief, as well as a homestead exemption increase, entirely dependent on the passage of sales tax increases by voters on the November ballot.
Burrows, obviously frustrated by the amendment, then was questioned further by Democrat State Rep. Yvonne Davis of Dallas, who cornered Burrows and forced him to articulate the codependency of the bills—with relief being the furthest issue down the line.
“I think you have a very fine amendment here, Mr. Stickland,” Gutierrez said from the back microphone, foreshadowing what appeared to perhaps be an interesting alliance forming for taxpayers before the vote with both sides.
Bonnen indicated that Stickland had requested a record vote and that he, himself, would be voting ‘no,’ a Texas House rarity. Most members followed suit and the amendment failed, garnering a meager 5 ayes and a resounding 143 nays. The vote was a clear indication that the body politic of the Texas House is squarely with Bonnen and his leadership team at the end of the day. Three Democrats and two Republicans supported separating the two bills: Democrat State Reps. Michelle Beckley (Carrollton), Yvonne Davis (Dallas), and Harold Dutton Jr. (Houston), and Republicans Briscoe Cain and Jonathan Stickland.
Obviously, this is a terrible deal that any self-respecting legislator should reject.
But this is the Texas Legislature, and...well...they ain't exactly known for self-respect.
So here we are.
As we said yesterday:
Just for good measure:
Like we said: Toxic.
Bottom Line: New boss, something something; old boss, something something....

#TXLEGE: (at least) 5 Good Bills Getting Hearings Next Week
"For where your treasure is, there your heart will be also."
Luke 12:34
Tuesday; Senate Property Tax:
- SB 462 Campbell
Relating to ballot propositions authorizing certain political subdivisions to issue debt obligations.
- HB 238 Krause
Relating to the enforcement of certain federal laws regulating firearms, firearm accessories, and firearm ammunition within the State of Texas.
- HB 2 Burrows
Relating to ad valorem taxation. - HB 705 Geren
Relating to the substitution of a county sales and use tax for all or a portion of property taxes imposed by the county; authorizing the imposition of a tax.
Wednesday; House State Affairs:
- HB 281 Middleton
Relating to the use by a political subdivision of public money for lobbying activities.
[Note: They're not on this website's priority issues, but several other bills on the State Affairs docket also look good.]
Bottom Line: Just because a bill gets a committee hearing does not mean that bill will make it to the Governor's desk, but it's virtually impossible for that to happen without one.

#TXLEGE: Team Geren attempting to further milk false CPS report
"While they promise them liberty, they themselves are slaves of corruption; for by whom a person is overcome, by him also he is brought into bondage."
2 Peter 2:19
This is absolutely disgraceful; from the Inbox:
Bottom Line: Please Ft. Worth, for the love of all that is righteous, show this false CPS report filing, lobbyist fornicating, sexual predator enabling sociopath the door next Tuesday....Bo French Eviscerates Geren and his Democrat Allies’ Release of False CPS Report“You know they are desperate when their only hope is to use CPS one more time to allege child abuse”(Fort Worth, TX) On Wednesday the CPS report on the French family was leaked to the media in an attempt to, yet again, weaponize CPS and allege child abuse. The Quorum Report, an online blog, released the documents and noted that the conclusion was that the French family posed a “moderate risk” for child abuse. Left out, likely due to lack of research, was the fact that all families that don’t cooperate with CPS are noted as “moderate risk”.French laid out significant details stating, “This is again a new low for Charlie Geren. You know they are desperate when their only hope is to use CPS one more time to allege child abuse.Let me point out some facts:1. CPS will classify ANY parents who refuse to cooperate with a CPS investigation as presenting a “moderate risk” (as distinct from “low risk” or “high risk”) of future child abuse. The basis for the “moderate risk” classification is the failure to cooperate, but that logic is entirely circular; we declined to cooperate precisely because we don’t abuse or neglect our children, and we therefore don’t want them exposed to an invasive and humiliating CPS interview and exam. The report shows we knew it was a political attack from day one.2. CPS did NOT find any actual child abuse or neglect in 2016. Obviously, there was none, as our pediatrician confirmed in his examination of all four of our children the Saturday morning after the Friday night CPS visit. All CPS “concluded” in 2016 was, based on a default administrative assumption, was that there was a “moderate” risk of child abuse in the FUTURE. We are now living in the future; it’s 2018 and there have NOT been any additional reports of child abuse or neglect in our home, despite the fact that our four children are around “mandatory reporters” (teachers, doctors, nurses, coaches, etc.) all the time. Why no more reports or CPS visits since the 2016 election? Because, obviously, we do not abuse or neglect our children, and the one report ever made was politically motivated.3. Now let’s go back to the actual deposition; it’s clear to anyone who reviews Mr. Sorensen’s sworn testimony that he filed the false CPS report. But he did so with NO PERSONAL KNOWLEDGE about the health or welfare of our children. Sorensen testified that he has never met our children, never seen them in person, never been to our home, never been in the same room as our children, and he admitted under oath that he knows nothing about how we parent our kids. Stated another way, the Geren operative who phoned in the false CPS report admitted under oath that he knew nothing about the health or welfare of our kids. And, to be clear, this Geren campaign worker was NOT a mandatory reporter to CPS of any sort.4. The Geren aid who phoned in the false CPS report had NO REASONABLE BASIS for doing so. He admitted under oath that his ONLY knowledge of the welfare or health of my children was a snippet of conversation that he eavesdropped on, as he overheard me talking to my 2016 campaign manager about the purported injury to our youngest son’s ribs.5. Even as testified to by Sorensen, no child abuse could have occurred here because he acknowledged that we took our youngest son to a chiropractor, who is: (a) perfectly capable of diagnosing a broken bone; and (b) a mandatory reporter of suspected child abuse to CPS.6. Sorensen’s motivation was transparently political. He made the call the Friday before the Tuesday election. He “very badly” wanted to see Mr. Geren win. He had worked 60-70 hours per week, 6 or 7 days per week, for Geren’s campaign from June 2015 to March 1, 2016. Democrat Sorensen knocked on over 10,000 doors for Geren. He was heavily invested in Geren winning, and he “went the extra mile” to make that happen by calling CPS.8. Bottom line: Geren surrogates’ focus on the “moderate risk” of future abuse classification that CPS assigned to my family because we would not cooperate with the CPS investigation is as cynical as it is desperate. Geren’s staff created this CPS mess by making a completely false and baseless CPS report for transparently political purposes.9. Geren’s staff must be held accountable for weaponizing CPS is the 2016 race. It defies all decency that they are attempting to weaponized it again in the 2018 campaign.”

#TXLEGE: Charlie Geren staffer who filed false CPS Report's ASTONISHING Deposition Video
"All these evil things come from within and defile a man."
Mark 7:23
This is sick:
Highlights:
- "Did Charlie Geren call Texas Child Protective Services and allege that Bo and Sheridan French were abusing or neglecting their children?!?"
- (Democrat) lawyer tells him not to answer
- "You weaponized CPS for political purposes, didn't you sir?!?"
- (Democrat) lawyer again tells him not to answer.
- Note: If the answer to this question is "no," then it's an easy one to answer.
- "Are you the source of information in this report?!?"
- (Democrat) lawyer again tells him not to answer.
- "You made that tip to child services in an effort to give Charlie Geren's campaign a political advantage."
- (Democrat) lawyer again tells him not to answer.
- "It's fair to say, you were eager for Representative Geren's campaign to prevail."
- "Yes"
- "It's fair to say you were invested in the outcome of the campaign."
- (Democrat) lawyer objects.
- "You badly wanted Mr. Geren to win."
Bottom Line: Charlie Geren is a sociopath. This is what sociopaths do. Please Ft. Worth, finish this guy off....

#TXLEGE: Past few days illustrate EXACTLY why Sullivan left Austin
"Blessed are those who are persecuted for righteousness’ sake,
For theirs is the kingdom of heaven."
Matthew 5:10
We've said our piece about the stupidity of the Charlie Geren campaign's criminal complaint against Michael Quinn Sullivan. It's laughably absurd. But, in a discussion with the Texas Monitor about the Geren campaign's action, Sullivan makes a point that deserves further elaboration:
It only amplifies what we’ve been saying all along about the weaponizing of the criminal justice system in Travis County.BINGO.
A few years back, during a previous round of politicized intimidation, Michael Quinn Sullivan moved to Denton county specifically to escape the jurisdiction of the Travis County DA and the hack Democrat judges in Travis County.
With another frivolous complaint percolating in the Travis County DA, it would seem that Sullivan's original motivation to leave town has been vindicated (again).
To be certain: Given his professional responsibilities, Sullivan does come through town from time to time (usually towards the end of legislative sessions and prior to elections). But he doesn't live here. Anybody who actually does live here can tell you that.
Bottom Line: Adding yet another featherbrained political prosecution to the mix does nothing but confirm everything Michael Quinn Sullivan has ever said about the Travis County DA and the hack judges in this town.

#TXLEGE: Public Sector Unions for Charlie Geren
Do not be deceived: “Evil company corrupts good habits.”
1 Corinthians 15:33
In working on a longer piece about Charlie Geren (probably out tomorrow), we noticed interesting tidbits on the "endorsements" section of his campaign website:
Bottom Line: If you're wondering why so much of the conservative agenda seems to stall out session after session, look no further than the pro-big government special interest groups supporting leading "Republicans"....

#TXLEGE: Campaign that filed false CPS report last cycle files frivolous criminal complaint this cycle
"A merry heart does good, like medicine,
But a broken spirit dries the bones."
Proverbs 17:22
One of this website's longstanding frustrations with Republican campaigns is the lack of creative thinking. We tend to use the same, stale, rhetoric over and over again...then we wonder why large segments of the population tune us out. In that spirit, we welcome Empower Texans' recent mailer in the Charlie Geren/Bo French race.
At its core, the mailer is about Charlie Geren's decade plus sexual relationship with a (female) lobbyist. True, he finally did marry the poor girl last year. But, prior to that, they had been living in sin for a long, long time.
The satirical mailer purported to be from the "Texas Ethics Disclosure Board," an obviously fictitious entity. It gave voters written "NOTICE" that Charlie and Mindy have engaged in a decade long sexual relationship, then listed several of Mindy's lobby clients. Honestly, we wish we'd thought of it.
But you know an attack has been effective when it begets this level of ludicrous overreaction:
A criminal complaint against Empower Texans, a conservative group that mailed out an attack ad resembling an official government notice that targeted GOP state Rep. Charlie Geren, is “under review” by the Travis County District Attorney’s office, The Texas Tribune has learned.Obviously, the Geren campaign's position is absurd. The law in question was designed to protect actual governmental entities. In other words, if the mailer in question purported to be from the actual Texas "Ethics" Commission, that would have been highly illegal.
A person who self-identified as a Tarrant County voter sent a letter to the DA’s office alleging that the group ran afoul of a criminal law that prohibits people from posing as government authorities, correspondence obtained by the Tribune shows. Mindy Montford, Travis County's first assistant district attorney, confirmed that her office had received a complaint about the group on Tuesday.
The controversial mailer attacks Geren for his “relationship” with a lobbyist — who happens to be his wife, Mindy Ellmer. What voters see in bold letters when they open the mail piece is “NOTICE,” above a slightly smaller font that says, “Of Relationship With Registered Lobbyist.” Then it lists Ellmer's long list of corporate lobby clients.
The mailer purports to come from the “Texas Ethics Disclosure Board,” an official-sounding name that Empower Texans registered with the Secretary of State's office late last month. There is no such government agency, though there is a Texas Ethics Commission that polices campaign and lobbyist disclosure rules.
....
"They're trying to deceive my constituents," said Geren, a top target of the group. The longtime Fort Worth lawmaker, one of outgoing House Speaker Joe Straus' top lieutenants, said the advertisement was designed to look official.
"It looks like it's coming from a state agency and it's not," Geren said. "A guy at church handed it to me and said what is this. I said it's another lie by Empower Texans, and he said, 'Well it looked real.' "
The complaint alleges Empower Texans may have violated a provision of the Texas Penal Code, under section 37.11, which prohibits people from posing as government officials. Specifically, the law says a person commits a third degree felony if he “knowingly purports to exercise any function of a public servant or of a public office, including that of a judge and court, and the position or office through which he purports to exercise a function of a public servant or public office has no lawful existence under the constitution or laws of this state or of the United States.”
That's not what happened.
In this instance, the entity in question was not an actual governmental body. Thus, the law in question doesn't apply. Furthermore, fictional organizations that are not what they purport to be are nothing new in Texas politics.
[Note: That being said, this is the Travis County DA we're talking about, so anything's possible.]
But here's the kicker: Charlie Geren is the guy whose campaign operative filed a false CPS report against Bo French's family last cycle. Now, they're filing a frivolous criminal complaint. We've seen this movie.
Finally, not that it's relevant to the discussion, we have to include a clip from this Texas Monthly screed because it's too funny not to share:
Michael Quinn Sullivan’s Latest Stunt Aims to Undermine our Democracy[Note: You can read the whole thing here; that being said, given that Texas Monthly was recently caught in a pay-to-play scheme for website traffic, you might want to think twice before giving them the clicks.]
As if anyone needed further proof, MQS’s bogus mailer shows that he is no better than Russian trolls.
At a lanky six-foot-four, Michael Quinn Sullivan is hard to miss around the Capitol. And even when he’s not there, it can feel like the specter of him still is. As president and CEO of Empower Texans, he has been an organizational force among the tea party groups of Texas, feeding them misinformation about state politicians. The man is known as Mucus (a play on his initials, MQS) because he engages in yucky deceptive politics, with a win-at-any-cost philosophy. His methods, like those of the Russians who meddled in the 2016 election, foment distrust in government and diminish the desire of citizens to vote, which then primes the pump for abuse.
Sullivan’s latest political stunt is case in point. On January 28, Empower Texans, operating under the assumed name of the Texas Ethics Disclosure Board (there’s no such thing) sent postcards to voters in the Fort Worth district of Representative Charlie Geren. It read: “This notice from the Texas Ethics Disclosure Board is directed to voters in HOUSE DISTRICT 99 concerning a candidate for office who must disclose a relationship with a registered lobbyist pursuant to Tex. Gov’t Code 572.0531.” It then lists the clients of lobbyist Mindy R. Ellmer, who, it just so happens, is Geren’s wife.
The clear intent of this mailer was to mislead voters into believing that Geren had done something wrong, or at least suspect.
....
Because of their dark money, groups like Empower Texans thrive in the shadows of secrecy and misinformation, using the same kind of loopholes that allowed Russian spies to try to manipulate voters in the 2016 elections. A cockroach that dashes across a plate at a picnic only spoils a small portion of the meal, but almost everyone will throw away the entire plate of food rather than risk contamination. That is how a democracy is spoiled.
Bottom Line: It's common sense. If you don't want people to come up with creative ways to inform voters that you've had a decade long sexual relationship with a lobbyist, don't have a decade long sexual relationship with a lobbyist. If you choose to have a decade long sexual relationship with a lobbyist, and a watchdog group informs the voters in a creative way, that's no excuse to file a bogus criminal complaint.

#TXLEGE: Ted Cruz ENDORSES McNutt, praises French....
"As iron sharpens iron,
So a man sharpens the countenance of his friend."
Proverbs 27:17
From the first day early voting inbox.
First Thomas McNutt:
I'm honored and humbled to announce Ted Cruz has endorsed our campaign!
"We are blessed in Texas to have so many solid conservatives running for office. I’m asking Texas voters to carefully consider the choices before them this election cycle, and to stand with those who have proven themselves to be conservatives of conviction. I am proud to endorse Thomas McNutt for Texas House and urge the voters of the 8th District to join me by supporting him."
~Senator CruzNext, Bo French:
When EVERY campaign tries to act like the conservative choice on the ballot, it’s extremely helpful for a warrior like Senator Cruz to provide clarity on the true conservative choice.
Sen. Cruz Applauds Bo French's Conservative LeadershipBottom Line: Obviously, these races are no-brainers for anyone paying attention (ie. people who read this website), but Cruz's actions clarify matters for the broader public.
French running against Liberal Charlie Geren for Tarrant County District
(FORT WORTH)-- Today, U.S. Senator Ted Cruz released a statement praising the campaign and candidacy of Bo French for the Texas House of Representatives in District 99.
Sen. Cruz said: "Bo French has displayed a passion for his conservative principles and a commitment to his community that is not often seen in politics. Numerous trusted conservatives have endorsed his campaign, including Texas Right to Life, Texans for Fiscal Responsibility, the Texas Home School Coalition, and Gun Owners of America, among many others - a testament to his hard work."
French is a businessman, rancher and investor from Fort Worth. In the primary he faces long-time incumbent Charlie Geren, who has represented the district for the past 18 years. During that time, Geren has consistently received failing grades from conservative organizations around the state such as Texans for Fiscal Responsibility and Texas Right to Life.
Sen. Cruz continued, "Bo's experience as an entrepreneur, service to his hometown of Fort Worth, and conviction in defense of his values have been widely recognized and are important characteristics in any GOP candidate."
Bo French and Charlie Geren are the only two candidates for District 99 in the Republican Primary being held on March 6, 2018. District 99 covers the northwest corner of Tarrant County. French and Geren also faced each other in the primary in 2016. The Texas House of Representatives has 150 members elected to two-year terms.

#TXLEGE: Team Geren seeks to DELAY ACCOUNTABILITY for false CPS report

"Woe to those who rise early in the morning,
That they may follow intoxicating drink;
Who continue until night, till wine inflames them!"
Isaiah 5:11
[Note: Empower Texans has more here.]
From the Inbox:
Democrat Activist and Former Geren Staffer Tries to Delay Deposition
(Fort Worth, TX) On Friday, David Sorenson, the Democrat activist and former paid staffer for Representative Charlie Geren (R-Fort Worth) who is accused of filing a knowingly false CPS complaint against the French family sought to delay his court-ordered pre-election deposition, which is currently scheduled for next Friday, February 23.
Sorensen’s last-ditch attempt to delay his deposition until after the election began with changing legal counsel. Late Friday afternoon, Steve Maxwell entered the case as lead counsel for Sorensen. Maxwell is a former Democrat Party Chairman in Tarrant County.
Sorensen’s new legal team immediately filed an Anti-SLAPP Motion to Dismiss. This Anti-SLAPP Motion to Dismiss automatically stays discovery—which would include staying Sorensen’s court-ordered pre-election deposition scheduled for this upcoming Friday. Sorensen’s responses to the French family’s written discovery—which would have revealed Sorensen’s role in making the false CPS report on the eve of the 2016 election—were also due yesterday, but were not provided due to the 11th hour stay triggered by the Anti-SLAPP Motion. Notably, a word-for-word identical Anti-SLAPP Motion was filed by Sorensen last fall, and then denied by a Tarrant County District Court.
French commented on this desperate legal maneuver stating, “Charlie Geren's political machine is pulling out all the stops to keep the truth from coming out. We were set to depose Mr. Sorenson next Friday, but they can't let that happen. Today they filed a motion, claiming that our suit violates their client’s First Amendment right to file the false report with CPS. They are seriously claiming that the First Amendment creates a right to file false reports with law enforcement to hurt a political opponent. I find that absurd.”
Chris Kratovil, counsel to Bo French also commented stating, “I have been practicing law in Texas for 17 years, and this is the hardest I have ever seen any witness in any case resist being deposed. It certainly begs the question why this defendant is fighting so desperately hard to postpone answering questions under oath.”
Charlie Geren claimed to the Fort Worth Star-Telegram that not only did he not know about the CPS complaint, he was also unaware that multiple staffers were in a legal battle going back to last June 2017. Geren has attempted to convince his community that the entire Fort Worth legal community knew that his staff was in a legal battle but he was completely unaware until he received a phone call from the press six months later.
This last-minute legal maneuver will likely delay the deposition of Mr. Sorenson until after the March 6th primary election.

#TXLEGE: Abbott makes serious proposal re: Capitiol Culture of Chronic Sexual Abuse (but questions remain)
"However, he would not heed her voice; and being stronger than she, he forced her and lay with her."
2 Samuel 13:14
Since the first (recent) reports of chronic sexual abuse in the legislature first surfaced three months ago, we've been waiting for someone, anyone, to make a serious proposal to address the situation. The new house policy, passed by Charlie Geren, was as pathetic as we predicted. The Senate, meanwhile, is twiddling its thumbs.
Yesterday, Governor Abbott stepped into the vacuum:
Following accusations of sexual misconduct against multiple state legislators, Abbott proposed that the Texas Rangers’ Public Integrity Unit be placed in charge of investigating these reports. The governor's office estimates that charging the Rangers with the task would require $2 million in funding. This is...interesting.
“By allowing these cases to be reported to the Texas Rangers ... we can ensure that claims are investigated by an impartial law enforcement body that is equipped to hold public servants accountable,” Abbott said.
The good news: In the three months that recent reports have been out, this is the first time anyone in a position of real power has made a serious proposal on this issue. Obviously, this website has been critical of Governor Abbott over the past couple years. But, he's the first person to make anything remotely resembling a serious suggestion, so we applaud him.
Furthermore, the Texas Rangers might be a good entity to investigate claims; they have a good reputation, and they know how to do this work.
Nevertheless, some questions:
- What happens with behavior that isn't criminal?!? -- The Texas Rangers are a law enforcement organization. That means their primary purpose is to gather evidence for criminal prosecutions. But, in many of these cases, the objectionable behavior isn't necessarily illegal.
For example: Borris Miles forcibly kissing a woman probably constitutes some form of assault. But Borris Miles aggressively propositioning an intern or Carlos Uresti inquiring about a woman's underwear, while disgusting and horrid, probably isn't criminal. The criminal justice system can handle cases involving physical assault, but it's not well equipped to handle verbal harassment or intimidation.
Will the Texas Rangers have jurisdiction in non-criminal cases?!? If not, do we want to give it to them?!? What would the unintended consequences of such a move be in 20 years?!?
- What sanctions will exist for bad actors?!? -- The Texas Rangers will probably be able to investigate claims well...but what happens once they find something?!?
Are there going to be any actual penalties for this behavior?!?
In this website's opinion, two specific sanctions would go the furthest: Loss of committee chairmanships and expulsion from the chamber; so far, neither of those are under discussion. - How long will investigations take?!? -- The Texas Legislature only has 140 days to complete its business. Everybody knows that "delay equals death" in the legislature. What will prevent investigations from dragging out until the session is already over anyway?!?
The slow-moving, bureaucratic, nature of government is bad enough...but once you add that members might have an incentive to move things as slowly as possible, it doesn't take a genius how this sort of policy could be rendered toothless.
Two weeks seems like a reasonable amount of time after the survivor has come forward, but that's not currently under discussion.
- When will the public be informed?!? -- One of the reasons the culture of chronic sexual abuse at the Capitol became so entrenched is because everything gets handled behind closed doors.
Will the public learn at the beginning of an investigation?!? At its conclusion?!? Or is the type of thing that will require regular and diligent open records requests?!?
Sunlight is the best disinfectant and all that.
- Do these proposed changes require the legislature to pass a bill -- If so, see what the house did with Abbott's proposed ethics reforms the past two sessions.
[Note: Isn't it interesting that Charlie Geren, the same guy who killed Abbott's ethics reforms, is also in charge of the new sexual harassment policy.]
- Will Abbott follow through?!? -- You'll pardon us if we've seen this movie before. Greg Abbott holds a high profile press conference where he says everything you want to hear. Then, when the rubber meets the road, his personal involvement is...inconsistent at best.
For example: In 2017, Abbott outlined a great special session agenda. Then, during the special session, Abbott was nowhere to be found, and only about 30% of the good elements of his agenda passed. Then Abbott promises to hold the legislators who killed his agenda accountable. While Abbott has endorsed against three of the afore mentioned legislators, he's also let at least half a dozen others off the hook. Again...inconsistent at best.
When it comes to Greg Abbott, at this point, actions speak a lot louder than anything he says at a high profile press conference during an election year.
Bottom Line: Governor Abbott is the first prominent elected official to make a serious proposal. For that, he deserves credit. But we need to work through several more questions before we can have any confidence that behavior in the legislature will change.

#TXLEGE: An older quote that encapsulates the sleazy nature of the Charlie/Mindy Geren relationship
"Whoever loves wisdom makes his father rejoice,
But a companion of harlots wastes his wealth."
Proverbs 29:3
We were researching a separate project this week when we re-discovered this gem from 2015:
One of the most frequently asked questions the operatives have posed to legislators is whether it is proper for lawmakers and lobbyists to date. The question seemed a direct jab at Rep. Charlie Geren, R-Fort Worth, a top House lawmaker who has a decade-long relationship with lobbyist Mindy Ellmer.Obviously, Geren was lying (what else is new?!?), but we were struck anew by the sleaziness of the whole ordeal given what's subsequently transpired in the past three years.
"I find it offensive," Geren said. "Mindy and I aren't trying to hide anything. She doesn't lobby me. She never has and she won't. That's the deal we've got."
And yes, this is the man overseeing the Texas house's new sexual harassment policy.
And yes, that new policy is every bit as pathetic as you might suspect.
Bottom Line: Yes, it really is this sordid and this trashy....

#TXLEGE: Charlie Geren's new sexual harassment policy is just as pathetic as we predicted....
"While they promise them liberty, they themselves are slaves of corruption; for by whom a person is overcome, by him also he is brought into bondage."
2 Peter 2:19
Game, set, match for the Texas Observer:
After reports surfaced in November that women have for years endured sexual harassment in the Texas Capitol, leaders in the House promised, among other actions, to provide sexual harassment training to legislators and their staff. We’ve got the training, and it’s a 40-minute video that seems unlikely to change the toxic atmosphere at the statehouse any time soon. The Observer piece is well-worth reading in full, but it closes with a recommendation that this website fully endorses:
The training is a video of a PowerPoint presentation with a voiceover that also covers discrimination based on race, age, disability and genetics. Just 18 minutes of the video is dedicated to sexual harassment, including boilerplate examples of harassment, reasons to prevent it, laws against sexual harassment, the House’s policy and reporting mechanisms.
The whole video has a feeling of, ‘Let’s quick minimize liability on every front, watch this video,’” said Joanna Grossman, a law professor at Southern Methodist University who researches sex discrimination and workplace equality.
Recent research shows that if training isn’t properly designed, it’s unlikely to lead to more reporting of harassment, much less reduce instances of inappropriate behavior. According to Eden King, a psychology professor at Rice University, there’s some evidence that training programs have better outcomes when they are longer than four hours, include face-to-face interaction, involve interactive learning, are conducted by outside experts and actively involve leaders in the workplace. The House video meets none of those criteria.
Instead of being paired with an interactive, in-person training as recommended by researchers, the video is available on the House’s internal server and is probably watched alone. Viewers are required to take a 10-question, multiple-choice test. To pass, you must answer at least seven questions correctly. If you fail, you can simply retake the test without having to watch the video a second time.
....
When institutions face allegations of sexual harassment, Grossman said, the instinct is often to establish programs that reduce legal liability. The law tends to reward somewhat “superficial or simplistic” measures, she said, such as merely implementing a policy or conducting training. A 2016 report from the Equal Employment Opportunity Commission found that most of the harassment training conducted in the last 30 years has failed to reduce harassment and has instead been used to meet legal requirements. “Ineffective training can be unhelpful or even counterproductive,” the report noted.
....
Research shows that to create an environment of equality, institutions must go beyond training. One crucial aspect is to ensure that victims feel they have a safe way to report complaints.
Grossman said that to truly address harassment, the Legislature should conduct a comprehensive audit and study its work environment.Yes, please do, and while you're conducting said audit, please keep in mind what we said a couple weeks ago about the toxic culture at the Capitol not being limited to sex.
[Author's Note: Emphasis added.]
Bottom Line: It's appalling. But it's also not surprising. What would you expect from a guy who's been engaged in a sexual relationship with a lobbyist for most of the past decade?!?

#TXLEGE: Abbott's property tax related political theater includes FOUR (recent) tax-hikers
![]() |
| Left: Villalba, Geren and Button today in Ft. Worth; Right: Jim Murphy yesterday in Houston |
"He who works deceit shall not dwell within my house;
He who tells lies shall not continue in my presence."
Psalm 101:7
[UPDATE: It gets better, apparently Bonnen voted for HB 486 in committee.]
[UPDATE II: Apparently, Giovanni and Linda Koop were there as well, which just further illustrates our point.]
Question: What do Angie Chen Button, Charlie Geren, Jim Murphy, and Jason Villalba have in common?!?
Did they?!?
- a) Vote to grease the skids for property tax hikes last session?!?
- b) Appear at one of Governor Abbott's recent press conferences promoting his property tax plan.
-- OR --
- c) BOTH.
The answer, unfortunately, is "C."
Over the past 2 days, Governor Abbott has held press conferences in both Houston and Ft. Worth extolling the benefits of his new property tax proposal. In fairness to Abbott (as we explained yesterday) it's a good proposal. Unfortunately, many members of the cast of characters with whom Abbott has chosen to surround himself leaves us...less than sanguine about the proposal's chances of passage.
As a particlarly flagrant example of why, consider HB 486 from last session:
Next, consider which Republicans voted for HB 486 and cross reference them against attendance at Abbott's press conferences:
Bottom Line: If you want us to believe that you're committed to reigning in the property tax system, you probably shouldn't surround yourself with four legislators who voted to grease the skids for further property tax increases as recently as last May.
Next, consider which Republicans voted for HB 486 and cross reference them against attendance at Abbott's press conferences:
- Angie Button (R–Richardson)
- Charlie Geren (R–River Oaks)
- Jim Murphy (R–Houston)
- Jason Villalba (R–Dallas)
Bottom Line: If you want us to believe that you're committed to reigning in the property tax system, you probably shouldn't surround yourself with four legislators who voted to grease the skids for further property tax increases as recently as last May.
