Creative Lawyering for Good

Ken Paxton is one lucky duck. The Texas attorney general was asked the kind of friendly, easy question that allowed him to twist the nose of an organization he doesn’t like under cover of state law.

It’s not a secret that Paxton is opposed to abortion. That opposition has long been a centerpiece of his campaigns as he rose from the Texas House to the Senate to his current position. It’s hard to imagine that he wants Planned Parenthood to have more resources.

And given a chance to say that a new state law creates an obstacle to some of that organization’s funding, he grabbed it.

The question posed to the state’s top lawyer was whether Planned Parenthood can continue to be one of the beneficiaries of the State Employee Charitable Campaign. State workers who sign up for the voluntary campaign give a little bit of money from each paycheck to the program, which then distributes the money to charities chosen from an approved list.
This is so great.

SB 22, as it passed, did nothing.  It was one of those fake pro-life bills that the lege likes to pass.  It creates the appearance of being pro-life, without actually doing anything.

The stated purpose of SB 22 was to crack down on practices by the City of Austin.  Of course, the City found a loophole almost instantly.   In other words, the lege wasn't able to accomplish even the stated objective of this watered down bill.

Thanks to Ken Paxton, however, it looks like something useful will come out of the effort.

Bottom Line: It's a small win.  But it's a win in an area that previously would have been a loss.  Kudos Ken Paxton.

Obviously, we've opposed Prop. 6 since we first heard about it. CIPRIT has been scandal plagued for years.  They don't need an additional $3 Billion.

But we didn't expect Planned Parenthood to get in on the act.

Then again, we never expected NARAL and Wendy Davis to show up here.

Bottom Line: We already thought Prop. 6 was a boondoggle, but this is all the more reason to oppose it....

#TXLEGE, #atxcouncil: "Abortion access" workaround illustrates POINTLESS STUPIDITY of original lege bill

Of course they did:
AUSTIN (KXAN) — Austin City Council members were joined by advocates at City Hall Monday afternoon when they announced their proactive budget measure to protect residents’ access to abortion services.

Last week, four city council members announced they planned to support up to $150,000 of city money being used to support transportation, childcare and counseling for women seeking abortions.

Mayor Pro Tem Delia Garza attended alongside council members Greg Casar, Leslie Pool and Paige Ellis, who were joined by representatives of several abortion rights advocate groups, including the Lilith Fund and Fund Texas Choice.

Under the budget, local tax dollars would help pay for services like rides to and from a clinic. Under Texas law, it is illegal for local tax dollars to directly support abortion providers, so city council members say their decision aims to work around the barriers put in place.
Is anyone surprised?!?

Because if you are, you've been living under a rock.

During session, our state 'leaders' touted SB 22 as a major pro-life victory:
Texas Gov. Greg Abbott on Friday signed legislation that prohibits cities and counties from doing business with abortion providers. The bill, which takes effect Sept. 1, specifically prevents local governments from entering into reduced tax and lease agreements with such organizations. It also prevents cities and counties from "advocacy or lobbying on behalf of the interests of an abortion provider or affiliate."

It does not impact hospitals or doctor's offices that perform fewer than 50 abortions per year.

Clinics that could be impacted include the Planned Parenthood in East Austin, which signed a 20-year lease with the city for $1 per month.
 Blah, blah, blah.

For council to find a cleverly lawyered way to technically comply with the letter of the law, while gutting its spirit, was completely predictable.  That they did so is a textbook illustration of why that bill was always a waste of time.  Anyone who tells you otherwise is a dullard, a liar, or a twit.

Imagine what could have happened if the lege had taken advantage of the opportunity to pass bills that actually did something.

(But send money....)

Bottom Line:  Council's action are awful.  Duh.  They're also completely predictable considering the incentives the lege created.  Spare us the phony outrage.

Judicial "merit selection": An idea so AWFUL, Nathan Hecht deserves a primary....

In the wake of a midterm election that swept some 20 Republican appellate judges out of office, Texas Supreme Court Chief Justice Nathan Hecht called on the Texas Legislature to reform a system he called “among the very worst methods of judicial selection.”

“When partisan politics is the driving force and the political climate is as harsh as ours has become, judicial elections make judges more political, and judicial independence is the casualty,” Hecht told both chambers of the Legislature on Wednesday morning in his biennial address, a wide-ranging speech that touched on judicial salaries, technology and bail reform. “Make no mistake: A judicial selection system that continues to sow the political wind will reap the whirlwind.”

In recent history, partisan judicial elections have played well for Texas’ majority party; the state’s two high courts, in which justices run statewide, comprise all Republicans, as they have for two decades. But last year, as turnout surged in urban areas and voters leaned heavily toward the straight-ticket voting option, Democratic judges were swept onto the bench on the coattails of candidates like Beto O’Rourke. All told, Hecht said, in the last election, Texas’ district and appellate courts “lost seven centuries of judicial experience at a single stroke.”

“Qualifications did not drive their election,” Hecht said. “Partisan politics did.”
No, no, no, no, no, no, no.

So-called "merit selection" takes the selection of Judges away from voters and puts it into the hands of bureaucrats.

We hope we don't have to explain why that's a terrible idea.

Several years ago, local activist Mark Pulliam wrote an essay detailing the pitfalls of so-called "merit selection."  It's too long to quote in full.  You really should read the whole thing.  The following stands out:
In reality, though, merit selection is usually controlled by the organized bar. Lawyers as a group are not representative of the general population, and lawyers active in the state bar (or the ABA) tend to be particularly partisan and ideological. (The policy positions adopted by the House of Delegates of the ABA, for example, are indistinguishable from those of the ACLU, and are far left-of-center of mainstream public opinion.) Merit-selection panels, such as the Judicial Nominees Evaluation (JNE) Commission in California, tend to become captured by special-interest groups (such as plaintiffs’ lawyers,...liberal political activists, etc.), who use the evaluation function to black-ball judicial candidates who don’t share their views—such as conservative lawyers or proponents of civil-justice reform.
In Texas, the practical impact of such a change would likely be a Judiciary that's significantly friendlier to trial lawyers and Planned Parenthood.

Again, we hope we don't have to explain why that's a terrible idea.

With the substantive question addressed, lets consider another aspect: The arrogance of the idea that judges shouldn't have to campaign for office.

Perhaps we're old fashioned, but we think judges should have to interact with the citizens that will have to live under their rulings.

Like it or not, for many judges, the only time they interact with regular citizens is during campaign season.

Nevertheless, the current system remains in place for 2020.

And Nathan Hecht is up this cycle.

This sort of proposal should NOT be allowed to stand.

Once again, however, the silence of Texans for so-called "Lawsuit Reform" is deafening.  Hecht's speech was Wednesday.  It's now Saturday.  That Texans for so-called "Lawsuit Reform" has yet to blow a gasket tells you everything you need to know about that operation.

Voters suck...but unelected bureaucrats suck more.

Interesting fact about Nathan Hecht we only learned in preparing this blog post: He's  been on SCOTX for over 30 years.

He's also almost 70.

Besides this "merit selection" nonsense, dude might want to consider retiring on those grounds alone.

Bottom Line:  Taking power out of the hands of voters, and putting it into the hands of bureaucrats, rarely works out well in the end.

Hensarling Endorses Pounds

When Lance Gooden recently told an audience, "I did not run to be a Republican platform value upholder," his record proves that he meant it.

According to numerous conservative and independent organizations, Lance Gooden consistently ranks among the most liberal GOP House members in Austin.He's ranked the 5th most liberal Republican in the Texas legislature, and he can't even qualify for membership in the Texas Conservative Coalition — an organization comprised of the vast majority of his Republican colleagues.

• Gooden aligned with the position of Planned Parenthood and voted to kill legislation that would have banned certain late term abortions.

• Gooden worked to defeat Governor Abbott's effort to bring relief to
homeowners from what the Governor called "the skyrocketing rise in property taxes."

• Gooden has received contributions from the AFL-CIO which is
advocating for the Obama DACA program and amnesty.

Fortunately, there is a choice. Bunni Pounds has resided in the 5th Congressional District for over 16 years, and I've known her for over a decade. She is a conservative stalwart and a successful small businesswoman. I know her courage and her integrity. I know her commitment to freedom, life, economic opportunity, the 2nd Amendment, and to securing our borders. She will be a champion for our cause like few others.

Furthermore, Bunni has been endorsed by a number of strong conservatives, including Vice President Mike Pence. Vice President Pence endorsed Bunni because he knows she'll work with him and the president to "Make America Great Again." In fact, on a recent trip to Dallas the Vice President asked to meet with Bunni specifically to discuss ways she can help advance the Trump agenda. If you have supported me and if you support President Trump and Vice President Pence, don't be fooled by the conservative words of liberal Lance Gooden. Please support President Trump and Vice President Pence by sending them an ally. On May 22nd, please vote for Bunni Pounds. You'll be proud you did.

Bottom Line: Honestly, we're kind of shocked to see a sitting Congressman admit that the Texas House of Representatives is filled with liberals. But we'll take it. Go Jeb Hensarling.

#TXLEGE: Media Correction of the (Young) Year

Late yesterday afternoon, we posted to Facebook about wanting to write a longer...critique...of a sensationalistic article the Trib published about a Texas House race West of Waco.  Chris Evans, the TxRTL endorsed challenger to a liberal Republican incumbent, apparently got in some legal trouble a decade and a half ago.  The original article was a transparent opposition research dump fed to a credulous reporter who subsequently posted a click driven story.

The Trib has subsequently updated the story.   It's now straight news recounting.  Since they fixed their story before we got a chance to write this blog post, we'll cut them some slack.

But the correction they posted is mint:
Correction: An earlier version of this story incorrectly described Texas House candidate Chris Evans as having been convicted for possessing a pipe bomb. He received deferred adjudication for the offense.
Gee..what could you have possibly been trying to imply by saying he was "convicted" for possessing "a pipe bomb"?!?

That being said, the funniest part is how the Trib's unforced error allows Chris Evans to run a media-bashing campaign the rest of the way.  Expect messaging along the lines of "you know the liberal media is scared of Chris Evans because they're already attacking him."  As a point of comparison, if you're wondering how that messaging will resonate in that district, just remember the HD-59 is Sid Miller's old district (*).

Bottom Line: This was a funny unforced error.

Texas Medical Association gets deeper into bed with Planned Parenthood

The so-called Texas "Medical" Association is a liberal special interest group who routinely attempts horrible things in the legislature.  Of their many transgressions, the worst is that they're rabidly pro-Abortion.  On that note:
Planned Parenthood of Greater Texas has named Dr. Sealy Massingill as its new chief medical officer.

As CMO, Massingill will oversee clinical staff at health centers in Dallas, Denton, Fort Worth, Waco, Austin, Corsicana, Paris, Tyler, and surrounding communities. He will also be in charge of managing Planned Parenthood’s direct patient care site at Southwest Fort Worth health center.

Massingill currently is president-elect of the Texas Association of Obstetricians and Gynecologists and Section 2 Chair for District XI of the American College of Obstetricians and Gynecologists. Previously, he served as president of the Texas Medical Association Foundation and president of the Tarrant County Medical Society Board of Directors.

#TXLEGE: In typical Straus move, Sarah FRIGGIN' Davis to oversee abortion related budget subcommittee....

Joe Straus' commitment to defending preborn babies has always been...suspect.  While he's muddied the waters, and there's a stronger case to make against him on other issues, that discussion has never gone away.  This can only revive it:
Article II of the state budget appropriates state funds for various health divisions (i.e. the Department of Aging and Disability Services, Department of Family and Protective Services, Department of State Health Services, and the Health and Human Services Commission). From these funding streams, Texas Right to Life was able to identify and remove $62 million from abortion organizations, adopt strict funding rules, and increase funding to the Alternatives to Abortion program.

This legislative session, Pro-Life Texans must be even more diligent in watching potential funding of the abortion industry due to the person tapped to chair the House Appropriations Subcommittee on Article II, State Representative Sarah Davis (R-West University Place). Davis is the only Republican who is openly anti-Life and endorsed by Planned Parenthood.

Appointed to chair the subcommittee on Article II by Speaker Joe Straus, not only does Representative Davis have an abysmal record on Pro-Life issues, she also scores poorly on all fiscal indexes. In fact, last Session Davis passed an amendment in the same subcommittee to undo Pro-Life language the Senate had written to ensure that Planned Parenthood did not receive state funding through the Breast and Cervical Cancer Screening Program. Such a record clearly indicates she is not the best Republican, out of 94 Republican members, to be chairing a committee tasked with overseeing Texas tax dollars.

Last week’s meeting in the Article II subcommittee showed a glimpse into Davis’ intent to secure funding for additional pet projects undermining the Pro-Life values of Texans. After testimony from a doctor praised the family planning program in Texas, Rep. Davis asked the witness about an exaggerated study attempting to blame Texas’ maternal mortality and morbidity rate (MMR) on the state’s efforts to stop state funds from going to Planned Parenthood. The study and Representative Davis’ position, seek to correlate decreased taxpayer funding of Planned Parenthood to the study’s alleged maternal death rate.

The MMR study has been shown to be flawed in many aspects, including failing to take into account that states and countries throughout the world do not have a standard reporting apparatus. The MMR study also failed to parse how many maternal deaths, defined as death within one year of giving birth, were attributed to heart disease, drug use, and hypertension – the three leading causes of death for Texas women. However, such facts do not fit neatly into the abortion left’s deceptive talking points.

Davis’ interest and reliance on such a misplaced “study” further shows Texans she is bent on restoring taxpayer funding of the abortion industry in Texas.

It was bad enough that Straus appointed a pro-Obamacare spendaholic to chair the Appropriations committee; now that same spendaholic (whose own commitment to life is questionable at best) appoints the only Republican endorsed by Planned Parenthood to oversee the subcommittee that oversees Planned Parenthood's state funding (and no, the State of Texas has not defunded them).

Bottom Line: We've seen this movie before, but good grief...

Bush Progeny's Revealing Reminder of Family History

Barbara Pierce Bush, the daughter of former President George W. Bush, will headline a Planned Parenthood fundraiser in North Texas on Wednesday.

She will be the keynote speaker at Planned Parenthood of Greater Texas' annual Fort Worth luncheon, helping to raise money for an organization that provides an array of reproductive and sexual health services, including abortions.

....

But it's not entirely unexpected. Bush's mother, former First Lady Laura Bush, has expressed support for the legality of abortion on a handful of occasions. The younger Bush, the CEO and co-founder of Global Health Corps, called Planned Parenthood an "exceptional organization" in a June New York Times interview, and attended a fundraiser for Democratic presidential candidate Hillary Clinton in Paris in October.

Jeb Bush's grandfather, Prescott Bush, was an active supporter of Planned Parenthood, which was founded by Margaret Sanger in 1921 as the American Birth Control League. In 1947, Bush served as treasurer of the group's first national fundraising campaign—a move he would soon come to regret. In 1950, Prescott Bush narrowly lost an election for a US Senate seat in Connecticut after a columnist revealed his connection to the "Birth Control Society."
Bottom Line: Never ever, ever forget that the Bush crime family helped turn Planned Parenthood into the genocidal force it is to day; any pro-life pretenses any of them make are politically convenient lies.

First Major Pro-Life SENATE Bill of 85th #TXLEGE Filed!!!

We've yet to make final decisions about how we will pursue the life issue next session, but this is a strong start:



Bottom Line: What you really need is a full ban on dismemberment abortions (to say nothing about a full ban on ALL abortions), but considering political reality at the Capitol this might be an achievable step towards eliminating the most abhorrent practices in which we learned two summers ago that Planned Parenthood was engaged.

Texas continues funding Planned Parenthood....

Rah, rah Texas GOP; from the Trib:
But after an initial feint at cutting off the money, the state has little to show for it. Abbott, who generated national media attention and launched fundraising emails over the issue, still expects “the appropriate authorities to move forward in eliminating taxpayer funding for Planned Parenthood,” his spokeswoman said.

Meanwhile, Texas Health and Human Services Inspector General Stuart Bowen, an Abbott appointee and the state official who led the move to defund the women’s health organization, faces an uncertain future as the state’s top fraud investigator, as his appointment expired in February. A spokesman for the governor declined to say this week if Bowen would be reappointed.

Planned Parenthood is by and large keeping its head down, continuing to provide services as the initial political hullabaloo has faded.

In the Medicaid fight, the governor’s public relations campaign began the same day last year that state inspectors delivered a notice of intent to boot Planned Parenthood from the public insurance program. A press release that day from the governor’s office boasted the headline: “Texas Eliminates Taxpayer Funding To Planned Parenthood Providers.” The next day, Abbott was interviewed about it on Fox News.

Texas gave Planned Parenthood 30 days to respond its notice and request an “informal resolution meeting” with health commission attorneys. If the organization did not act, the state said it would issue a “final notice of termination,” formally ending Planned Parenthood’s participation in Medicaid. That order would have gone into effect 15 days after the organization received it.

But the state has never issued the final notice.

It appears the inspector general’s delay in issuing the final termination of Planned Parenthood’s Medicaid contract is out of line with the agency’s previous practices, according to a Tribune analysis of similar notices sent to other Medicaid providers.

For the most part, we think the Trib story speaks for itself.  We also, for the most part, draw the obvious conclusion.  That being said, we can't overlook an alternative hypothesis that reflects certain realities of how government operates that might be more charitable to Abbott.

One unfortunate reality of large government bureaucracies is that the bureaucrats frequently do whatever the heck they wish while ignoring the elected representatives of the people.

So, while we still think the obvious conclusion from the Trib article is also the most likely one, we can't overlook the possibility that Abbott is doing everything he can given the current system and that the bureaucrats are blowing him off (*).

* -- Of course, if this is the case, the real solution is to take a much deeper ax to the agency's budget than anyone at the capitol would be willing.

40 Days for Life Launches Spring Campaign in Austin!!!

This evening, the 40 Days for Life campaign held kickoff events in hundreds of cities around the planet; here in Austin, they met outside the Planned Parenthood facility on Ben White.

40 Days for Life is a global event that holds semi-annual prayer vigils outside abortion facilities.  The goal is to peacefully and prayerfully put the facilities out of business.  Globally, 40 days for life has saved over 11,000 babies from abortion and rescued 127 clinic workers from the abortion industry since it's inception in 2007.

Here in Austin, this is the fifteenth campaign.  To our knowledge, at least 222 women have changed their minds during that time, saving at least 225 babies from abortion.  Nine clinic workers have left the abortion industry during that time, including three in the past four months!

"This is mission work in our own backyard!"

The ASTONISHING race for Court of Criminal Appeal, Place 2....

Over the past few years, few trends in Texas politics have been more disturbing than the criminalization of conservative speech; even more disturbing is the fact that two corrupt judges who have presided over sham grand jury investigations against conservatives are now attempting to obtain the same statewide judicial position.

The Court of Criminal Appeals is the highest criminal court in Texas.  The Court of Criminal Appeals is to criminal law what the Texas Supreme Court is to civil law.  The court is comprised of nine judges each of whom is elected statewide.

In the current race for Place 2, there are three candidates in the Republican Primary: Mary Lou Keel, Chris Oldner, and Ray Wheless.

We've previously discussed Judge Chris Oldner on this website; heck, we've filed a complaint against Oldner with the State Commission on Judicial Conduct.  Oldner is the corrupt Collin County judge who helped railroad Ken Paxton's indictment.  There's your first example of criminalizing conservatism.

Older is bad enough, but this race becomes truly astonishing when Keel enters the picture.  Unfortunately, this past Monday, a grand jury in Harris County returned a legally problematic indictment against David Daleidan who produced last summer's investigation into Planned Parenthood's sale of baby body parts.  Now take a wild guess which Judge presided over that grand jury.  THAT'S RIGHT: Mary Lou Keel!!!  That's your second example of criminalizing conservatism.

We've met Ray Wheless.  He seems like a solid guy who understands the proper role of a Judge.  At a minimum, he's (quite literally) the ONLY candidate in this race who hasn't overseen a bogus political indictment against a prominent conservative in the last six months.

Bottom Line: It boggles the mind that these two bottom feeders are both trying to run statewide considering their recent records.

Takeaways From Straus' Interim Charges

Joe Straus released a list of 243 interim charges on Wednesday morning; having finally reviewed them, some thoughts:
  • Dan Patrick and Jeff Judson are living rent-free in his head:  The most important aspect of these interim charges is that they were released in the first place.  Dan Patrick released his STRONG conservative interim platform a month ago while Judson has been hammering him for weeks about his failure to act following the Planned Parenthood expose.  Clearly, Straus felt he needed to respond.
  • Priorities: Straus' interim charges fall under three categories: Lobby priorities, "Wide-consensus" priorities, and Conservative priorities; in our estimation, 38% of them were lobby priorities, 51% were wide-consensus, and 11% were conservative.
  • Protecting Byron Cook: State affairs received ten interim charges.  Four address conservative issues: economic collapse preparation, Planned Parenthood, illegal immigration, and union dues.  Cook has already called a hearing over illegal immigration on December 10th and we expect similar show hearings throughout campaign season.
  • LOTS of action for lame duck chairmen:  Jimmie Don Aycock, John Otto, and Jim Keffer are all retiring. Nonetheless Appropriations, Public Ed. and Natural Resources got 37 combined. charges.  The overwhelming majority of those charges are bad.
  • Appropriations, Charge 3: "Examine Texas constitutional spending limits compared to limits utilized in other states, evaluate their effectiveness in maintaining fiscal discipline, and recommend potential modifications, if needed."
  • Appropriations, Charge 16: "Evaluate the effectiveness of the Department of Public Safety’s use of funds appropriated during the 84th legislative session for border security operations. Examine existing data and reporting on border security metrics, and recommend improvements to ensure the availability of accurate information in considering sustaining or increasing border security funds."
    • Expect a report full of cheap-labor-lobby/Democrat talking points about the 'effectiveness' of border security efforts without any mention of the Federal 'catch-and-release' program.
  • Business and Industry, Charge 3: "Evaluate how Texas can support shared economy growth in the state. Determine how the state can ensure customer security and satisfaction as well as consumer protections without enacting burdensome regulations. Additionally, study the effects of a growing portion of the state's workforce seeking full-time vs. supplemental part-time employment with related technology-based businesses. Analyze recent debate and legal precedent regarding the classification of these employees."
    • The fact that Straus doesn't use commonly accepted nomenclature to describe the sharing economy illustrates he doesn't understand it (which one would expect from someone who describes the economy the same way as Obama).
  • Criminal Jurisprudence, Charge 3: "Examine the use of asset forfeiture in this state, including data reporting on forfeiture actions and procedures from seizure through forfeiture in both contested and uncontested cases. Make recommendations for improving these systems that balance law enforcement needs, private property rights, and government transparency."
    • Expect a report full of cop-lobbyist talking points about some sort of "vital law enforcement program"
  • Economic and Small Business Development, Charge 2: "Evaluate what local governments are doing to attract businesses to their communities and examine ways the state can leverage these practices and provide support. Include ways to improve local economic development programs to ensure a continued return on investment for taxpayers. In addition, study the authority, financial accountability, and types of statutorily allowed expenditures of economic development corporations. Provide analysis of 4A and 4B sales tax programs and determine if they are still meeting their intended purpose effectively."
    • Taxpayer funded lobbyists and assorted rent-seekers LOVE this one!!!
  • Economic and Small Business Development, Charge 8: "Examine partnerships between higher education institutions, public school districts, and workforce that promote postsecondary readiness. Provide coordination recommendations to ensure vocational, career, and technical education programs are more accessible. Determine the most effective ways to invest in these partnerships and programs to direct at-risk students to stable career paths. Examine current rules and laws limiting employers from providing meaningful internships, apprenticeships, and other opportunities. Consider new methods to finance workforce training programs and associated assets in high schools and postsecondary schools, including ways to reduce or eliminate these costs and options to incentivize businesses to invest in training equipment for schools. (Joint charge with the House Committee on Public Education)"

  • Elections, Charge 1: "Examine the petition process for addressing local ordinances, the time necessary to prepare a petition, the collection of signatures, and the enforcement of local standards required for a petition to be valid. Make necessary recommendations to clarify the petition process to ensure accountability."
  • Energy Resources, Charge 3: "Study current renewable energy regulations in Texas in order to more effectively balance federal, state and local regulations. Review the rights of Texas landowners who receive royalties, operating fees or monthly production payments to ensure fairness. Explore opportunities to maximize existing wind infrastructure toward the promotion of additional renewable energy development such as co-location for generation and transmission. In addition, consider policy solutions to incentivize colocation of simultaneous surface electricity and mineral energy production."
    • Straus ACTUALLY did an interim charge over 'renewable energy'; we could stop there....
  • Government Transparency and Operation, Charge 3: "Study issues related to access to public information held outside of the custody or control of the governmental body by current or former officers or employees. Assess whether the Public Information Act's procedures for response to repetitious or redundant public information requests adequately protect small governmental bodies from the financial burdens imposed by such requests."
    • NOTHING good can come from this.
  • Higher Education, Charge 3: "Study the affordability and accessibility of undergraduate college education in Texas, including a focus on middle-class students. Analyze the cost of attendance and tuition rates, comparing Texas institutions to their national peers. Review the availability and effectiveness of financial aid programs, and analyze student debt and default rates. Study and recommend ways to promote timely and cost efficient graduation."
    • A source points out this charge is ingenuously worded to look like the leadership actually cares about middle class families, but is carefully littered with UT politburo buzz words.

  • Judiciary and Civil Jurisprudence, Charge 2: "Examine whether family law statutes and those affecting the parent-child relationship provide sufficient guidance to Texas judges as to the appropriate application of foreign law. Consider whether additional statutory provisions regarding application of foreign law could provide useful guidance while preserving judges' ability to consider the circumstances of each case and not needlessly prolonging litigation."
  • Juvenile Justice and Family Issues, Change 6: "Examine the Texas Family Code’s treatment of grandparents in the parent-child relationship, including Chapters 32, 34, 153, 161, and 162 and suggest any changes that may be useful to address the growing population of grandparents and the best interests of Texas children and families."
  • Land and Resource Management, Charge 4: "Examine current regulatory authority available to municipalities in their extraterritorial jurisdiction. Study current annexation policies in Texas. Make necessary legislative recommendations to ensure a proper balance between development, municipal regulations, and the needs of citizens in Texas."
  • Licensing and Administrative Procedure, Charge 1: "Identify all occupations licensed by the state to determine if they are necessary for public safety and health. Determine if any criminal penalties associated with licensure are unnecessarily punitive, recommend methods to improve reciprocity with other states, and determine if a mandatory certification program could be used in lieu of mandatory licensure."

  • Natural Resources, Charge 4: "Evaluate the progress of seawater desalination projects near the Texas coast as a means of increasing water supplies and reducing strain on existing supplies, building on the work of the Joint Interim Committee to Study Water Desalination (83rd session). Examine the viability of the use of public-private partnerships and of methods by which the state might facilitate such a project."
  • Public Education, Charge 8: "Study ways to increase parental choice in education, and review the successes and failures of school choice programs in other states. Examine the benefits and costs of implementing such a program in Texas. Recommend whether an expansion of school choice in Texas is needed, and suggest ways to ensure that any school receiving public support is held accountable for its academic and financial performance."
    • Expect a report full of pro-government school propaganda (esp. concerning 'rural school districts') to confuse the debate when the Senate reports.

11 videos in...why hasn't Joe Straus investigated Planned Parenthood?!?

The Center for Medical Progress' Planned Parenthood expose began early this summer.  Since then, the Governor, Lt. Governor, and Attorney General have acted.  On that note, Jeff Judson highlights the inaction from the Texas House:
With the release of the 11th video showing Planned Parenthood clinics selling fetal body parts, the urgency of the Texas House to hold hearings is more pressing.  Over 100 days ago, our Governor, Lt. Governor and Attorney General took action.  But Speaker Straus has taken no action whatsoever.
On July 14th, Governor Abbott directed “the Texas Health and Human Services Commission to conduct an immediate investigation of this alleged practice in addition to a separate investigation ordered by the Texas Office of the Attorney General.” As a result, state of Texas investigators served subpoenas at three Planned Parenthood facilities to determine whether their employees are guilty of defrauding the state’s Medicaid program.
On July 15th, Lt. Governor Dan Patrick called for “expedited” hearings after the first Planned Parenthood video surfaced.  His statement included the following:  “I am requesting that Senator Charles Schwertner and the Senate Health and Human Services Committee conduct an interim hearing within the next month to ensure no laws are being broken. The committee will report back to the full Senate on Planned Parenthood’s business practices conducted in Texas, and make whatever recommendations are appropriate.” (Emphasis added)
On July 15th, Attorney General Paxton said “The Office of the Attorney General has launched an official investigation into Planned Parenthood following the release of a video that details the organization’s calculated slaughter of human babies to maximize the available body parts they plan to sell.”
The inaction of Speaker Straus is deplorable.  Other than a political statement Straus mentioned in an obscure video on the Bexar GOP website where he said “you will see the Texas House committees … getting into this issue themselves” sometime before January 2017, the Speaker has done nothing.  What is the Speaker waiting for?  The need for an investigation and to inform House members is immediate.
“Speaker Straus’ continuing delay in calling for hearings reveals his lack of leadership, his lack of concern for these abhorrent acts by Planned Parenthood and a lack of appreciation for the role of the House of Representatives in fulfilling its role in investigations,” said Jeff Judson, Candidate for HD 121.  “The time for hearings is now, not during the holidays, and not right before the March 1 primary as a political show-hearing in January or February.”

Bottom Line: Whatever token concessions Joe Straus makes to political reality on the life issue, the Texas House's continued inaction four months into the CMP's expose speaks for itself.

When the latest Planned Parenthood Video Occurs in Your Neighborhood

Yesterday we saw the most personally unsettling episode of the Center for Medical Progress' Planned Parenthood expose:



In the video, the Abortionist discusses performing abortions in the last facility in Austin.  Planned Parenthood South Austin is that last Planned Parenthood facility in Austin that performs abortions.  That facility is two miles from this Author's apartment.

It's impossible to describe how alarming it is to know this level of barbarism is up the street from you until you experience it.  But it is.  Singing louder like the "Christians" in 1930's Germany isn't an option.

Not coincidentally, this facility is the primary focus of the ongoing 40 Days for Life campaign in Central Texas.  Knowing that to be the case, we went out this afternoon to pray at the facility.  We were there for half-an-hour.



During that half hour, we saw five women enter the facility; two were Hispanic, two were Black.

The best way to disrupt the abortion industry is to pray for individual clinic workers.  We'll start there.  Cahnman's Musings asks readers to pray for Amna Dermish.

Bottom Line: Here I am Lord, send me.

When Planned Parenthood Helped Elect J.D. Sheffield

[Author's Note: Current state reps Ken King and Chris Paddie also received assistance from Planned Parenthood during the 2012 cycle, but they have been far superior on pro-Life issues since taking office than Sheffield.]

J.D. Sheffield was first elected to the Texas House in 2012.  He defeated former state rep. (and current Agriculture Commissioner) Sid Miller.  Over the weekend, we learned something fascinating about that race we'd missed at the time:

Landtroop, who was ousted from the House in this week's primary runoff election by GOP rival Ken King of Canadian, had joined Republican State Reps. Wayne Christian of Center and Sid Miller of Stephenville on the list of lawmakers who Planned Parenthood considered to be its three biggest enemies in the Texas Legislature.

But the family planning organization sensed that GOP legislators who'd been attacking it relentlessly in Austin were out of touch with a majority of Republican women voters back in their districts. So Planned Parenthood launched an informal but vigorous networking effort with telephone calls and emails in hopes that it could help give Landtroop, Miller and Christian the boot from the Legislature in the 2012 primary election.

Despite the fact that a variety of different factors appeared to contributed to the outcome of the races involving the GOP legislators that Planned Parenthood targeted, the group may deserve some of the credit even though it didn't pump money directly into the campaign coffers for the challengers who won.

In the eyes of Planned Parenthood, the incumbent House trio in question had been at the forefrtont of a war that the Republican supermajority in the lower chamber declared on the group under the banner of the pro-life crusade. With more Republicans than ever on both sides of the rotunda, the House took the lead last year on legislation that had the effect of excluding Planned Parenthood from the Women's Health Program, which provides health care services to low-income women. While state law already prohibited tax dollars from being used for abortions, the law that emerged from the Legislature last year took the additional step of banning facilities that are affiliated with abortion providers from the women's health initiative.

Texas legislators had already slashed funding on women's health clinics by more than 50 percent in a move that experts said would cut off family planning services for 300,000 poor women. The Landtroop amendment was designed to choke off the flow of state money to Planned Parenthood by severing it from the women's health program.

Miller, an 11-year House veteran who'd emerged as a member of Speaker Joe Straus' leadership team at the start of the session last year, sponsored landmark legislation last year that requires women to have sonograms before obtaining an abortion. Miller touted touted the role that he had in a move in the state budget battle that cut more than $20 million in funding that had been going to Planned Parenthood.

The state's largest physician group contributed $35,000 to Sheffield in the final week of the runoff fight with Miller. TMA's political arm TEXPAC donated a smaller amount to King, who already amassed as a larger war chest than any House candidate on the runoff ballot. But the TMA has steered clear of the abortion debate even though it turned out to be on the same page with Planned Parenthood in the races that pit challengers against Landtroop, Miller and Christian.

Gerald Daugherty's ASTONISHINGLY large pro-Courthouse Donation

The pro-Courthouse bond committee's 30-day campaign finance report is very revealing.

Gerald Daugherty is the only Republican on the Travis County Commissioner's Court (Page 9):


By Comparison, Daugherty's fellow Commissioner's Court member, County Judge Sarah Eckhardt (Page 10):


It's worth noting that the other three members of the Travis County Commissioner's Court (Ron Davis, Margaret Gomez, and Brigid Shea), to their credit, haven't given the pro-Courthouse committee a dime.  Eckhardt's donation appears to be a token effort.  In other words, Daugherty has donated literally TWENTY TIMES what the other four commissioners have donated COMBINED.

Next, let's compare Daugherty's donation to other well known figures around Travis County.

Bottom Line: For Gerald Daugherty to have given more money to the pro-Courthouse committee than Sarah Eckhardt, Mandy Dealy, David Beck, and Bill Powers COMBINED is incredibly disappointing...but it's also something we needed to know.

40 Days for LIFE Austin chapter KICKS off FALL Campaign!!!

Planned Parenthood South Austin -- Tonight, the Central Texas Coalition for Life launched the Fall 2015 campaign outside the Planned Parenthood facility in South Austin.  Dozens of people showed up to pray for an end to abortion in our city.  Executive director Heather Gardner emceed the event.


40 Days for Life is a uniquely effective pro-life ministry.  It began in College Station (credit where due to the Aggies...gig 'em) in 2007 and since gone global.  Among its accomplishments:
  • Over 579 cities in all 50 states and have conducted a 40 day prayer vigil at the local abortion facility
  • At least 30 different countries have conducted a 40 day prayer vigil including: England, Northern Ireland, Brazil, Peru, Canada, Australia, Denmark, and Spain
  • Over 10,330 women haven chosen life for children they were going to abort – because of the peaceful presence of people in front of the abortion facilities
  • at least 118 workers in abortion facilities have had conversions and quit their jobs
  • at least 60 abortion facilities have closed their doors and shut down for good
  • Thousands upon thousands of men and women with abortions in their past have finally found healing

  • They've also seen miracles locally:
  • 213 women have chosen life for 216 babies that were going to be aborted (three women were pregnant with twins)
  • 7 workers have had conversions and left the abortion industry for good!
  • Over 3,000 people have brought prayer to the streets of Austin in front of these abortion facilities
  • People from more than ONE HUNDRED churches have united arm-in-arm at the local 40 Days for Life prayer vigils
  • Thousands of women have been redirected to local pregnancy resource centers for help through their pregnancy and beyond
  • Many men and women with abortions in their past have found healing
  • Local newspapersradio stations and magazines have featured the local 40 Days for Life helping to spread awareness about the injustice we stand against

  • Gardner also discussed 40 Churches for 40 Days, whereby an individual Church can commit to covering one days' worth of prayer shifts during the campaign.
